SECOND AMENDED AND REVISED FINAL RESOLUTION AUTHORIZING
INSTALLATION OF SEWER IMPROVEMENTS AND
LEVYING SPECIAL ASSESSMENTS AGAINST
BENEFITED PROPERTY
(Loomis RoadlDrive Sewer Project MSS-1A-96)
(Assessment District "SM")
WHEREAS, Final Assessment Resolution #167-96 was adopted on July 23, 1996 and
Amended and Revised Final Assessment Resolution #19-97 was adopted on February 11,
1997; and
WHEREAS, The Public Utilities Committee has recommended that the Amendment to the
Assessment Policy for Construction of Sanitary Sewers adopted by Reso. #235-98 As
Amended on January 26, 1999 be applied to the above Final Assessment Resolution with
relation to the following assessment as it has been impossible since prior to November 1, 1997
and is now impossible, based on government restriction for this property, to make use of the
improvement because the Wisconsin Department of Transportation would not grant this
property access to STH 36, which made development of the property impossible; and
WHEREAS, Said highway will become a City street effective November 15, 1999 in
accordance with the Jurisdictional Transfer Agreement between the Wisconsin Department of
Transportation and the City of Muskego, and said restriction will no longer be in effect:

Change interest starting date on deferred assessment from November 1. 1997 to November 1,
1999
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego.
upon the recommendation of the Public Utilities Committee, does hereby amend the Final
Assessment Resolution #167-96, to reflect the changes noted above.
BE IT FURTHER RESOLVED That all remaining sections of the Final Assessment Resolution
#167-96 and Amended and Revised Final Assessment Resolution #19-97 shall remain
unchanged unless specifically amended by this Resolution.
