RESOLUTION #230-94
APPROVAL OF CONDOMINIUM PLAT
(Overlook Bay)
WHEREAS, Plans were received on October 7, 1994 to convert the
Overlook Bay Development into a Condominium Plat whereas each
building will be under separate ownership while the grounds
under common ownership; and
WHEREAS, Overlook Bay Apartments were approved by the Common
Council on December 11, 1990; and
WHEREAS, the overall density of this development will not be
be increased as controlled by the boundaries established by the
altered nor will the number of potential additional living units
Lake Forest Development's overall Planned Unit Development
concept; and
WHEREAS, the Plan Commission has recommended approval subject to
resolution of technical discrepancies as identified by City
Engineer, payment of all fees and charges as associated with
this plat, establishment of developers deposit for this plat,
Restrictions, payment of all outstanding fees that are due to
review and satisfaction by City Attorney of the Deed
the existing Developer's Deposit of the Overlook Bay
Development, submittal of a revised landscape plan for this
development.
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the
City of Muskego, upon the recommendation of the Plan Commission,
does hereby approve the Condominium Plat of the Overlook Bay
Development located in the SE 1/4 of Section 8 subject to the
conditions outlined by the Plan Commission and payment of all
outstanding fees due to the City.
BE IT FURTHER RESOLVED that all persons are hereby informed and
understand that approval of this Condominium Plat for Overlook
Bay neither constitutes an approval by the City for the design,
density, layout or architectural appearance of any buildings or
grounds on Parcel 2 as identified in Exhibit A of both the
