RESOLUTION #61-94
RESOLUTION TO AUTHORIZE HIRING OF SPECIAL PROSECUTOR
WHEREAS, citations issued to Paul M. DeAngelis and Arthur Dyer
have been transferred to the Municipal Court for the City of
Brookfield due to Judge Lentz recusing himself in each of these
matters; and
WHEREAS, the office of the City Attorney is not able to
represent the City in the prosecution of the DeAngelis case due
to a conflict of interest; and
WHEREAS, this matter will be handled in the City of Brookfield
Municipal Court; and
WHEREAS, since the City must appoint a Special Prosecutor for
the DeAngelis case, it would be more economical for the City to
also have said Prosecutor handle the Dyer case; and
WHEREAS, the Finance Committee has recommended authorization to
hire a special prosecutor, Attorney E. Joseph Kershek, at an
hourly rate of $75 to handle the above matters.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance
Committee, does hereby authorize the hiring of Attorney E.
Joseph Kershek at an hourly rate of $75 to act as Special
Prosecutor in the DeAngelis and Dyer cases in the City of
Brookfield Municipal Court.
