COMMON COUNCIL - CITY OF MUSKEGO
RESOLUTION #285-93
ACCEPTANCE OF BIG MUSKEGO LAKE DAM
WHEREAS, Resolution #219-86 adopted September 23, 1986 by the
Understanding Between the State of Wisconsin, Department of
Common Council of the City of Muskego approved a Memorandum of
Natural Resources and the City of Muskego Relating to the Repair
and Transfer of the Muskego Lake Dam; and
WHEREAS, Resolution #54-93, as amended and adopted March 9, 1993,
recommended a further inspection of the underwater portion of the
dam to determine the physical status of that portion of the dam
and the adequacy of the same; and
WHEREAS, it has been determined that it would not be financially
feasible to inspect the underwater portion of the dam; and
WHEREAS, the Finance Committee has recommended acceptance of the
Big Muskego Lake Dam subject to minor repairs being done and
title search; and
WHEREAS, the DNR will supply written correspondence stating that
the earthen dam was built to specifications and that the dam
spillway meets all current state requirements.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance
Committee, does hereby accept the Big Muskego Lake Dam contingent
upon minor repairs being completed to the City's satisfaction and
title being free and clear of all encumbrances and in a condition
satisfactory to the City Attorney.
BE IT FURTHER RESOLVED that the City Attorney is authorized to
order the necessary title evidence subject to all of the above
conditions being met.
