CCR1993071aCOMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION 1171-93 AMENDED RESOLUTION AS TO REVISED PRELIMINARY PLAT Plum Creek Addition X1 and Plum Creek East WHEREAS, a Preliminary Plat for Plum Creek Subdivision, a 231-unit subdivision in the SE 1/4 of Section 17, was approved by the Common Council of the City of Muskego on July 14, 1992; and WHEREAS, the Plan Commission approved a sketch for an amended Preliminary Plat on September 15, 1992; and WHEREAS, a Revised Preliminary Plat for Plum Creek Addition bl and Plum Creek East in the NW 1/4, NE 1/4 and the SE 1/4 of Section 17 was submitted on January 15, 1993 for 175 dwelling units. The Revised Preliminary Plat substantially conforms to the approved sketch and contains a portion of the land contained in the original Preliminary Plat; and WHEREAS, Plan Commission has recommended approval of the Preliminary Plat Planning Department, and Waukesha County Department of Transportation being subject to the concerns of the City Engineers, Waukesha County Park and addresssed; and WHEREAS, the Plan Commission has granted a variance regarding lot sizes adjacent to the floodplain in accordance with Chapter 18:2.5 of the Municipal Code, and WHEREAS, the Common Council rejected said Preliminary Plat as not conforming to the requirements of the Muskego Land Division Ordinance and other ordinances, and WHEREAS, the developer wishes to file a further amendment to said Preliminary to certain conditions and satisfactory to the Common Council's concerns Plat which has been approved by the Plan Commission on April 20. 1993 subject subject to the Plan Commission conditions and other conditions contained in this resolution. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon recommendation of the Plan Commission, does hereby approve the Further Revised Preliminary Plat of Plum Creek Addition X1 and Plum Creek East other approving agencies as noted above being addressed, and conditions revision date April 9, 1993 subject to the concerns of the City Engineers and imposed by the Plan Commission. BE IT FURTHER RESOLVED that this approval of the further revised preliminary Agency (FEMA) and any other approving agency, including the Common Council of plat is subject to approval by Wisconsin DNR, Federal Emergency Management map prepared by FEMA, and as required by the Plan Commission to maintain the the City of Muskego, of an amendment to the adopted flood boundary and floodway same required average lot width and size. Resolution #71-93 BE IT FURTHER RESOLVED that this approval is subject to Lots 27, 28, 29, 30, 36, 38, 101, 102, and a portion of the private park being removed from the of Muskego Floodplain Zoning Ordinance by amending the Official Floodway and floodplain by petitioning to amend Chapter 14 of the Municipal Code of the City Flood Boundary Map prior to a Final Plat being submitted and approved.
