DETERMINATION AS TO WHETHER THE CITY OF MUSKEGO WISHES
TO PROCEED WITH PURCHASE OF BIG MUSKEGO LAKE DAM
WHEREAS, the Common Council with Resolution #86-86, Stating
City's Response to State's Position of Big Muskego Lake Dam,
Understanding with the Department of Natural Resources, dated
dated April 22, 1986 and Resolution #219-86, Memorandum of
of ownership of the Big Muskego Lake Dam conditioned upon design
September 23, 1986 made certain statements concerning acceptance
improvements, Title, and other matters, and
WHEREAS, the State appropriated the money and contracted with a
firm to make improvements; and
WHEREAS, certain improvements were made in 1986, and
WHEREAS, THE City Engineers were not present during the time of
construction and by their Letter of June 24, 1992, expressed
their concerns, and
WHEREAS, dam ownership increases the City of Muskego's
coverage, and
liability and there are serious questions as to insurance
WHEREAS, there are allegedly title problems and other problems
with the dam, and
WHEREAS, the Council feels there remains serious concerns about
the reconstruction of the dam.
NOW, THEREFORE, BE IT RESOLVED that the Common Council Of the
City of Muskego does hereby direct the Mayor to work with the
dam and availability of liability insurance, and the City
engineers to determine the adequacy of the reconstruction of the
Attorney is directed to see that the titles to be conveyed to
the City are free and clear and fee simple title.
