RESOLUTION #244-92
DEFERRING PAYMENT OF SPECIAL ASSESSMENTS
(Lowe and Schmidt)
WHEREAS, the Common Council of the City of Muskego has
previously adopted Resolution #176-86 deferring the special
assessments of the Merle and Rufus Lowe, Jr. Property (Tax Key
#2229.992.001) and the Lawrence Schmidt Property (Tax Key
#2229.990.000); and
WHEREAS, the deferral period for said assessment expired on the
12th day of August, 1991; and
WHEREAS, the property owners wish to defer said assessments and
deferral policy of the City as adopted in Resolutions #175-86
the interest due at the end of said deferral period under the
as amended, #266-86 as amended, #68-89 as amended, and #186-89,
except as said policy may be varied by this Resolution; and
WHEREAS the Public Utilities Committee has recommended
re-deferral of these assessments for an additional five years.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of Muskego, at the request of Rufus Lowe, Jr. and Lawrence
Committee, as follows:

That the assessments deferred by Resolution #176-86 and
interest due thereon is deferred for five (5) years from
August 12, 1991, but only pursuant to the terms and
conditions of Resolutions #175-86 as amended, #266-86 as
amended, #68-89 as amended, and #186-89, unless
specifically amended by this Resolution.
As to the Lowe property, Key #2229.992.001, that interest
balance of $3,159.94 from August 12, 1986 until the entire
shall be charged at the rate of 8% per annum on the unpaid
assessment is paid in full with total principal and
interest due as of September 22, 1992 of $4,650.41.
As to the Schmidt property, Key #2229.990.000, that
interest shall be charged at the rate of 8% per annum on
the unpaid balance of $2,473.84 from August 12, 1986 until
the entire assessment is paid in full with total principal
and interest due as of September 22, 1992 of $3,639.39.

BE IT FURTHER RESOLVED that this Resolution is subject to the
approval of the City Attorney.
