CCR1992181AMENDED COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #181-92 APPROVAL OF CERTIFIED SURVEY MAP Plum Creek WHEREAS, a Certified Survey Map was submitted on June 10, 1992 to finalize a 4-parcel division of the Terra Development property on Woods Road in the SE 1/4 of Section 17; and WHEREAS, the Plan Commission has recommended approval subject to a temporary easement being recorded to provide access to Lot 4 via the future project entrance road and permanently restricting access for this lot to Woods Road and subject to placing a note on the Certified Survey Map which subjects these 4 lots to the deed restrictions which will be placed on the remaining single- family lots in the Plum Creek development and subject to recording a Declaration of Restrictions, as attached, limiting density to the remaining Plum Creek development. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve the Certified Survey Map to finalize a 4-parcel division of the Terra Development property on Woods Road in the SE 1/4 of Section 17 subject to the Plan Commission conditions stated above. Wisconsin 55072 (414) 691-4444 DECLARATION OF RESTRICTIONS WHEREAS, the undersigned are all of the owners of all of the land desm3ed on Exhibit 'A' which is attached hereto and made a pan hereof; and WHEREAS, the undersigned have requested the CITY OF MOSKEGO, hereinaner referred to as 'CITY. to rezone all of said land from RS-2 to RS-2 O.P.D.; and WHEREAS, the CITY has approved the concept of such a change; and WHEREAS, the undersigned now wishes to develop said properIy in phases; and WlEREAS, the undersigned wishes the zoning of the phase it now wishes to develop be amended to a four (4) lot CS.M as shown on Exhibit "B", and WHEREAS, the proposed phase does not in itself suppon the zoning change requested, but the property descrii on Exhibit "A" taken as a whole does suppon such a change if developed in accord with the concept which has been approved; and WHEREAS, the undersigned wishes the CITY IO enact the RS-2 O.P.D. zoning for the phase now to be developed and is willing to restrict the use of the remaining land to 127 single family lots, 22 duplex lots and 7 eight-family lots provided that none of the lands are within the 1M) year flood plain, shoreland-wetlands or wetlands. NOW, THEREFORE, BE IT RESOLVED, for valuable consideration aclolowledged by the undersigned, the following: 1.
