CCR1992176COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #176-92 ESTABLISHMENT OF GRIEVANCE PROCEDURE Americans with Disabilities Act of 1990 (ADA) WHEREAS, in order to comply with the Americans with Disabilities Act of 1990 (ADA), it is necessary for public entities that employ 50 or more persons to adopt and publish grievance procedures providing for prompt and equitable resolution of complaints alleging any action that would be prohibited by this Act; and WHEREAS, the Finance Committee has recommended approval of the following procedure: GRIEVANCE PROCEDURE Complaints alleging any action that would be prohibited by the Americans with Disabilities Act of 1990 (ADA) shall be handled as follows: Step One: The aggrieved person shall present the grievance in writing to the head of the department involved in the complaint within sixty (60) calendar days of the date of the occurrence causing the complaint. The Department Head shall notify the ADA Compliance Coordinator action to be taken. In the case of the Library or Parks & for informational purposes and assistance in determining Recreation Departments, the Department Heads shall forward the grievance with their recommendation to their respective Boards for action. Step Two: If a satisfactory settlement is not reached as outlined in Step One, the aggrieved person shall present the grievance in writing to the Finance Committee within one (1) week. Final action to approve or deny the grievance shall be taken by the Finance Committee within thirty (30) calendar days of receipt. Step Three: If a satisfactory settlement is not reached as outlined in Step Two, the aggrieved person shall appeal to the Common Council within one (1) week. Action shall be taken by the Common Council to uphold or overturn the Finance Committee decision within thirty (30) calendar days of receipt. The decision of the governing body is final. Recordkeepinq: All records pertaining to grievances Coordinator. shall be maintained in the office of the ADA Compliance Resolution #176-92 Page 2 NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Finance Committee, does hereby adopt the Grievance Procedure as stated above.
