CCR1992149PROPOSAL #1 COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #149-92 DECLARING AN EXTENSION OF A MORATORIUM ON LAND DIVISIONS WHEREAS, a moratorium on all new land divisions was imposed pursuant to Resolution #60-92 in order to give the Muskego Plan Commission time to consider adoption of a comprehensive master plan; and WHEREAS, as indicated in Resolution #60-92, such a plan or part thereof may recommend rezoning of certain portions of the City; and WHEREAS, said Resolution #60-92 indicated that the moratorium imposed by said resolution may need to be extended; and WHEREAS, the Plan Commission has not completed its study of the comprehensive master plan at this time. NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF MUSKEG0 DOES RESOLVE that in order to insure time for the Plan Commission to study and approve a comprehensive master plan, the moratorium imposed by Resolution #60-92 is extended to the first of the following dates: 1) The - day of , 1992; or 2) 30 days after the Muskego Plan Commission adopts a comprehensive master plan and enact an additional moratorium as to those rezoning pursuant to the recommendations of said comprehensive properties subject to said rezoning petition. Salentine This is to certify that this is a true and accurate copy of Resolution #149-92 which was adopted by the Common Council of the City of Muskego. 6/92cac City Clerk COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #149-92 DECLARING AN EXTENSION OF A MORATORIUM ON LAND DIVISIONS WHEREAS, the City of Muskego appointed a Comprehensive Master Plan Study Committee in December of 1989 to update the comprehensive master plan of the City; and WHEREAS, the Comprehensive Master Plan Study Committee on the 26th day of February, 1992 has submitted an updated comprehensive master plan; and in WHEREAS, the Muskego Plan Commission, pursuant to Wiscons Statute §62.23(3)(b), has considered adoption of a comprehensive master plan; and WHEREAS, the Plan Commission expects to adopt in the near future a comprehensive master plan which recommends rezoning a portion of the City; and WHEREAS, the Plan Commission has tentatively recommended rezoning of the properties listed on Exhibit "1" attached hereto master plan; and and made a part hereof, pursuant to the tentative comprehensive WHEREAS, the City anticipates commencing implementation of rezoning a certain portion of the City pursuant to the comprehensive master plan as was contemplated in declaring the initial moratorium as to this matter pursuant to Resolution such a rezoning are those listed on Exhibit "1" attached hereto #60-92 and anticipates that the properties to be affected by and made a part hereof; and WHEREAS, the moratorium includes a procedure for persons who believe they should not be subject to said moratorium to be heard. NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF MUSKEGO DOES RESOLVE that in order to insure time for the Plan Commission adopt the comprehensive master plan and for the Common Council to study the proper rezoning pursuant to the comprehensive master plan as tentatively approved, there is hereby a moratorium on the commencement of all new land division procedures within that portion of the City of Muskego subject to period of 4 months from the date of this resolution or Common anticipated rezoning procedures and listed on Exhibit "1" for a Council action on the rezoning of said property pursuant to the anticipated rezoning procedures, whichever occurs first. BE IT FURTHER RESOLVED that this moratorium does not affect land division procedures now in process which will be considered to be any land divisions for which the preliminary map or sketch prior to the passage of Resolution #60-92 along with the payment for a certified survey map or a preliminary plat has been filed of any appropriate fee. Resolution #149-92 Page 2 BE IT FURTHER RESOLVED that any person who believes they should Council for a waiver from the effects of the moratorium based not be affected by this moratorium may petition the Common upon the following criteria: 1. The petitioner claims to have vested rights which cannot be affected by anticipated rezoning pursuant to the comprehensive plan; and/or 2.
