RESOLUTION #135-92
AUTHORIZE FILING OF PETITION
TO AMEND CHAPTER 14, SECTION 1.5(2),
OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO
Floodplain Zoning Ordinance
WHEREAS, the Wisconsin Department of Natural Resources on
January 3, 1992 assigned a Hazard Rating Class 3, High Hazard,
for the Little Muskego Lake Dam; and
WHEREAS, the Hazard Rating was based on a study prepared by
City Engineer; and
the
WHEREAS, Chapter NR 116.05(4), WI Administrative Code, requires
that within 6 months from the time new study data is available
to a municipality by the DNR, the Municipality shall upgrade its
Floodplain Zoning Ordinance; and
WHEREAS, the City's Floodplain Zoning Ordinance is contained in
Chapter 14 of the Municipal Code and should be amended to comply
with the requirements of Chapter NR 116.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego does hereby initiate the filing of a petition to
amend Chapter 14, Section 1.5(2), The Floodplain Zoning
Ordinance, regarding the official floodplain zoning map for the
area south of the Little Muskego Lake Dam and authorizes the
Planning Director to file the petition.
BE IT FURTHER RESOLVED that the Planning Commission is requested
Common Council.
