CCR1992134COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #134-92 RESOLUTION AS TO ACKNOWLEDGEMENT OF INDEMNIFICATION Moonlighting -- Police Officers WHEREAS, the Police Chief has advised that the City of Muskego could be held financially liable while City police officers are employed as part-time officers for other communities; and WHEREAS, in the City's best interest, such part-time employment of City police officers without an indemnification acknowledgement was suspended by the Police Chief; and WHEREAS, the bargaining group for the Muskego Police Department has filed a grievance against the temporary order of suspension as being unreasonable; and WHEREAS, legal counsel for the League of Wisconsin Municipalities has recommended the attached acknowledgment be police officers while employed by other communities on a signed to protect the City's exposure from the actions of City part-time basis. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Police Chief, does hereby approve that the attached acknowledgement be signed by a designated municipal official of the community employing a City police officer on a part-time basis. We acknowledge Section 895.46, Wisconsin Statutes, responsibilities when Officer is proceeded against in any action or special proceedings whether in his official capacity or individual capacity because of acts committed while carrying out duties as a law enforcement officer for us. We also acknowledae that any iudqement as to damages and costs which may be ente;ed against Officer for acts committed while within the scope of his employment for US are our obliqation and are not the obligation of the City of Muskego and we will not look for contribution or indemnification from the City of Muskego.
