AUTHORIZATION TO APPEAL THE FINAL AUDIT REPORT OF THE DNR
WISCONSIN FUND STEP 3
(Manhole Rehabilitation Program)
WHEREAS, during the audit of the Wisconsin Fund Step 3 Grant by
the DNR, a review was made of the sewer user charge system of
the City; and
WHEREAS, on November 4, 1991 the DNR indicated the City should
not be billing in advance for services that have not yet been
received; and
WHEREAS, Resolution #16-92 was adopted on January 14, 1992
year 1993 in compliance with State regulations; and
indicating that the City will charge sewer user fees for the
WHEREAS, until those State regulations can be clarified, the
City desires to protect its rights to continue our current
practice for charging sewer usage; and
WHEREAS, an appeal to the DNR must be made within 30 days from
their March 24, 1992 letter; and
WHEREAS, any review by the DNR will be treated as a Class 2
contested case adjudicated in accordance with Chapter 227 Stats
and NR2 Wisconsin Administrative Code.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego does hereby direct the City Attorney to file an
appeal with the DNR regarding the method of charging sewer user
fees.
