RESOLUTION AS TO EXEMPTION FROM MORATORIUM

WHEREAS, on March 10, 1992, the Council adopted a resolution
declaring a moratorium on the commencement of all new land
division procedures; and
WHEREAS, the moratorium allows for any person who believes they
should not be affected by this moratorium to petition the Common
Council for a waiver from the effects of the moratorium; and
WHEREAS, the attached request has been received by JoAnn
Gillespie to be exempt from the moratorium.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
moratorium in effect.
City of Muskego does hereby deny exemption because of the 90-day

Dear Mr. Kirch,
I petition the City for an exemption from the current moratorium on land division,
Prior to the approval of the moratorium I have spent a considerable amount of time and
money on the design of a house and nursery outbuilding. I have potential buyers for my
existing house. I cannot go forward with this matter unless I can build another home on my
land.
My wetlands on the property have been set in a conservation easement in my will.
8 I intend to divide my land into two parcels for the purpose of establishing a separate
residence on one of the parcels. The moratorium was called to grant more time for study of
the Master Plan for the City. There are no changes in the present Master Plan for Field
Drive. Therefore I petition the City for an exemption to the moratorium because the
moratorium should not be applicable to my land &vision.
