CCR1992060CORRECTED COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #60-92 DECLARING A MORATORIUM ON LAND DIVISIONS WHEREAS, the City of Muskego appointed a Comprehensive Master Plan Study Committee in December of 1989 to update the comprehensive master plan of the City; and WHEREAS, the Comprehensive Master Plan Study Committee on the 26th day of February, 1992 has submitted an updated comprehensive master plan to the City for their consideration; and WHEREAS, the Muskego Plan Commission, pursuant to Wisconsin Statute §62.23(3)(b) is at this time considering adoption of said comprehensive master plan; and WHEREAS, the comprehensive master plan contemplates rezoning of portions of the City; and WHEREAS, the Plan Commission may adopt said plan or any part thereof or make amendments or additions thereto which may recommend rezoning the same or different portions of the City; 0 and WHEREAS, if the Plan Commission does adopt a comprehensive plan which recommends rezoning a portion of the City, this moratorium may need to be extended if the Plan Commission and/or the Common Council commences implementation of such a rezoning beyond the time limitations of this moratorium; and WHEREAS, the moratorium includes a procedure for persons who believe they should not be subject to said moratorium to be heard. NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF MUSKEGO DOES RESOLVE that in order to insure time for the Plan Commission to study and approve a master plan, there is hereby a moratorium on the commencement of all new land division procedures within the City of Muskego until the comprehensive master plan is approved by the Plan Commission or 90 days from the date of this resolution, whichever occurs first. BE IT FURTHER RESOLVED that this moratorium does not affect land division procedures now in process which will be considered to be any land divisions for which the preliminary map or sketch for a certified survey map or a preliminary plat has been filed prior to the passage of this resolution along with the payment of any appropriate fee. Resolution #60-92 Page 2 BE IT FURTHER RESOLVED that any person who believes they should not be affected by this moratorium may petition the Common Council for a waiver from the effects of the moratorium based upon the following criteria: 1. The petitioner claims to have vested rights which cannot be affected by revisions to the comprehensive plan or any subsequent rezoning; and/or 2.
