CCR1992045COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #45-92 APPROVAL OF CERTIFIED SURVEY MAP Smukowski WHEREAS, a Certified Survey Map was submitted on January 22, 1992 to finalize a one-parcel division of the Joseph Smukowski property on Thode Dirve in the NW 1/4 of Section 26, and WHEREAS, the Plan Commission has recommended approval subject to the conditions identified in Plan Commission Resolution #P.C. 21-92. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve the Certified Survey Map to finalize a Dirve in the NW 1/4 of Section 26 subject to the conditions one-parcel division of the Joseph Smukowski property on Thode identified in Plan Commission Resolution #P.C. 21-92. BE IT FURTHER RESOLVED that this approval is subject to receipt of all fees required by Section 10 of the Land Division Ordinance and approval of the City Engineer. Resolution #45-92 which was adopted by the Common Council of the 2/92cac RESOLUTION #P.C. 21-92 APPROVAL OF CERTIFIED SURVEY MAP IN THE NW 1/4 OF SECTION 26 JOSEPH SMUKOWSKI AMENDED WHEREAS, Mr. Joseph Smukowski has submitted a certified survey map to divide property in the NW 1/4 of Section 26, and WHEREAS, A sketch detailing this land division was approved by the Plan Commission through Resolution #P.C. 246-91, and that another sketch for a land division has been proposed in Resolution #P.C. 20-92, and WHEREAS, The proposed lot would be 134,000 square feet in size and meet the A - Agriculture Zoning District requirements for minimum average width and square footage and soil boring tests were conducted which found the on-site soils suitable for a mound system, and WHEREAS, The proposed lot contains existing outbuildings in excess of one (1) percent of the total lot area, however, Section 17.8.01 (7) B. 2 of the City's Code of Ordinances stipulates that the Plan Commission, at their discretion, can permit more than one (1) percent of the land area to be covered with outbuildings in predominantly undeveloped areas, and 8 unplatted lands does not conform to the building setback requirements of the A - Agriculture Zoning District, and WHEREAS, The existing building as shown on the adjacent WHEREAS, The land division describes a land dedication of 20,588 square feet and 60 feet in width for the future extension of Thode Drive which is to provide access to the site.
