CCR1992015COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #15-92 SPECIAL ASSESSMENT POLICE POWERS UNDER S66.60 WI STATUTES PRELIMINARY RESOLUTION DECLARING INTENT TO EXERCISE AS TO SANITARY SEWER ASSESSMENT AREA FOR HIGHWAY L WEST TO CROWBAR SEWER PROJECT (Project MSS-1-92; Assessment District "SE") RESOLVED by the Common Council of the City of Muskego, Wisconsin: 1. The Common Council hereby declares its intention to exercise its police power under 566.60, Wisconsin Statutes, to levy described area for special benefits conferred upon such special assessments upon property within the following property by installation of the sanitary sewers in streets abutting the following property: Sanitary Sewer Assessment Area HIGHWAY L WEST TO CROWBAR DRIVE SEWER PROJECT Project MSS-1-92 Assessment District "SE" LEGAL DESCRIPTION All that part of the Southwest and Southeast 1/4 of Section 18, Town 5 North, 0 Range 19 Eaet, bounded and described as follows: Commencina at the Northwest corner of the Southwest 1/4 of the Southeast 1/4 of - Section 18; thence Easterly 108.24 Feet; thence S 72O 30" E, 229.68 Feet; thence South 306.90 Feet; thence West 330.00 Feet to a point on the West line of the Southeast 1/4 of Section 18; thence South along said section line 1,085 Feet more or less to the Southwest corner of the southeast 1/4 of Section 18; thence Westerly along the South line of Section 18, 1,324.62 Feet; thence N 5O 15" W. 347.27 Feet; thence S 75' 45" W, 275.10 Feet; thence N 05' 45" W, 333.00 Feet to the centerline of Janesville Road; thence Northeasterly along said centerline of Janesville Road to the East line of the Southwest 1/4 of Section 18; thence Northeasterly along a straight line that would intersect with a point being 130 Feet South and perpendicular of the centerline of Janesville Road and 225 Feet West of Woods Road to the point of beginning, together with Tax Key Parcel Nos. 2231.993, 2231.997 and 2231.998.001. 2. 3. 4. See Attached Map The Common Council determines that the improvements constitute an exercise of the police power and the amount assessed against each parcel shall be based on front foot. The assessment against any parcel may be paid in cash or in annual installments. The City Engineer shall prepare a report which shall consist of: A. Final plans and specifications for the improvements. B. An estimate of the entire cost of the proposed sewer improvement project. Resolution #15-92 Page 2 C. Schedule of proposed assessments. 5. When the report is completed, the City Engineer shall file a copy of the report with the City Clerk for public inspection. 6. Upon receiving the report of the City Engineer, the Clerk proposed improvement, the general boundary lines of the shall cause notice to be given stating the nature of the proposed assessment area, including a small map thereof, the time and place at which the report may be inspected, and the time and place of the public hearing on the matters contained in the Preliminary Resolution and the report. This notice shall be published as a Class 1 Notice and a copy shall be mailed at least ten (10) days before the hearing to every interested party. I. Some of the proposed assessments may or may not be deferred by further action of the Common Council. 8.
