CCR1991293COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #293-91 RESOLUTION AS TO SEWER ASSESSMENT OF SPITZNER PROPERTY WHEREAS, Chester and Virginia Spitzner are owners of the following described real estate: Tax Key NO. 2227.988 PT E1/2SW1/4 SEC 17 T5N R20E COM AT Sl/8 POST, TH N 25.57 C, TH E 16.64 C BEARING W.O. 18 N60 E 3 L TH S 25.57 C TH W 16.64 C TO BGN EX 1079/403 1249/307 ALSO PT NW1/4 SW1/4 LYING S OF ELEC RR EX VOL 2/49 104/464 ALSO PT SW1/4 SEC 17 DESC VOL 1081/297 DEEDS .18 AC M/L VOL 1235/278 DEED EX CS 13/228 49.864 AC REM; and WHEREAS, said real estate is subject to the lien of the following described special assessment as of the 12th day of November, 1991 plus interest: Assessment District "SC" QUANTITY UNIT COST TOTAL COST Sanitary Sewer Front Foot Assessment 150.00 L.F. S 34.45 S 5,167.57 Sanitary Lateral Assessment 14.00 EACH 920.09 12,881.26 Deferred Frontage Assessment 1,508.00 L.F. 34.45 51,951.23 0 TOTAL ASSESSMENT $70,000.06 and WHEREAS, the above named owners are in the process of dividing said lands which affects the deferred portion of the assessment; and WHEREAS, the owners wish to pay the portion of the front foot sewer assessment plus laterals due on the parcel being sold, on the ten (10) year payment plan on the owners' tax bill, and (469.56 ft. and 5 laterals) in full; with 150 ft. and 9 laterals described above. 1038.44 ft. remaining deferred on the remainder of the property NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Muskego as follows: 1. The owners shall give the City satisfactory evidence of sole ownership of all the lands in question and the right to divide such assessments as proposed, and 2. The lands shall be divided and all appropriate documents making such division shall be filed and recorded, and 3. $20,776.79 plus interest shall be paid to the City upon acceptance of this agreement by all the owners to satisfy the lien of assessment and assessment for the 469.56 front property being sold, and foot sewer assessment and 5 laterals on the portion of the Resolution #293-91 Page 2 4. 5. 6. I. That the assessment on the remainder of the lands described in this Resolution for front foot sewer assessment and laterals, plus interest, shall be: 150 ft @ 34.45 9 Laterals @ 920.09 = 8,280.81 Ten (10) Year Payment Plan = $ 5,167.57 Ten (10) Year Payment Plan 1038.44 ft @ 34.45 = $35,774.26 Deferred; and Chester and Virginia Spitzner hereby waive all legal notices required to amend or change special assessments and agree to this special assessment without further action by the City, and All of the owners of the property described in this Resolution at the time of its acceptance shall be Chester and Virginia Spitzner and if the Resolution is not accepted on or before the 11th of December, 1991, it is null and void, and That the RCA (Reserve Capacity Assessment) remains on all of the property described in this Resolution and all properties remain responsible for appropriate sewer usage fees.
