APPROVAL OF ADDENDUM TO AGREEMENT
BETWEEN THE CITY OF MUSKEGO AND WISCONSIN ELECTRIC POWER COMPANY
(Recreation Trail)
WHEREAS, an agreement between the City of Muskego and Wisconsin
begin development of a Recreational Trail system throughout the
Electric Power Company was approved in Resolution #170-88 to
City of Muskego utilizing the WEPCO right-of-way, and
WHEREAS, the City and WEPCO would like to extend the
right-of-way as described on the attached legal description and
map, and
WHEREAS, the Parks & Recreation Board and the Finance Committee
have recommended approval of an addendum to the agreement for
the purpose of such extension.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Park &
Recreation Board and the Finance Committee, does hereby
authorize the Mayor and Clerk to execute the attached addendum
to the agreement between the City of Muskego and WEPCO for
approval to extend the right-of-way as described on the attached
legal description and map.
BE IT FURTHER RESOLVED that said Addendum is subject to the
approval of the City Attorney.

BY LICENSE AGREEMENT entered into the 23rd day of September, 1988, by
and between Wisconsin Electric Power Company, hereinafter referred to as
"Company", and City of Muskego. hereinafter referred to as "City", wherein
Company granted City license and permission to develop and use a part of
Company's right of way lands for hiking, biking and cross-country skiing for
obligations and duties. as set forth in said License Agreement.

. WHEREAS. Company and City now desire to make certain additional Company
right of way lands subject to the License Agreement and execute this Addendum
to the License Agreement for the purpose of adding the following described

being a part of the Northwest 1/4 of Section 16. and a part
a portion of Company's St. Martins to East Troy right of way
of Section 17, all in Township 5 North. Range 20 East. City
of the Northeast 1/4, Northwest 1/4. and the Southwest 1/4
of Muskego. Waukesha County, Wisconsin; the location of said
right of way is as shown and highlighted in yellow on the
attached drawing marked Exhibit "A" and made a part hereof.
NOM THEREFORE, for and in consideration of the mutual benefit of Company
and City, parties hereby agree to amend the subject License Agreement by
executing this Addendum incorporating that portion of Company's right of way
as described above. It is further understood and agreed that all other
terms, provisions and conditions as set forth in said License Agreement dated
September 23, 1988, as amended by Addendum dated August 13. 1991
shall remain in full force and.effect.
