FOR INSPECTION AND ZONING SERVICES
APPROVAL OF AGREEMENT AND FEES
FOR THE VILLAGE OF BIG BEND
WHEREAS, the Building Inspector has requested the Public Safety
Committee review the agreement and fees for inspection and
zoning services for the Village of Big Bend, and
WHEREAS, the Public Safety Committee has recommended approval of
the agreement and that the fee for inspection and zoning
per hour to $35.00 per hour.

NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Public Safety
Committee, does hereby approve the attached agreement and the
fees for inspection and zoning services to the Village of Big
Bend be increased from $25.00 per hour to $35.00 per hour
effective immediately.

INSPECTION AND RELATED SERVICES

1. PARTIES

2. PREAMBLE
A. State Statute subchapter I, 11, and I11 of Chapter 101
authorized the Department of Industry, Labor and Human
Relations to promulgate standards for the construction
of one- and two-family dwellings, including manufactured
dwellings, and to insure conformance to such standards
by the adoption of inspection procedures. Such
regulations were published in the Wisconsin Register
(December 1979) with an effective date of June 1, 1980.
B. Pursuant to the provisions of 101.65 and 101.76,
municipalities may exercise jurisdiction over the
construction and inspection of new dwellings by passage
of ordinances meeting the requirements of the one- and
two-family dwelling code. That the Village of Big Bend
has passed an ordinance approved by the Wisconsin
Department of Industry, Labor and Human Relations
allowing the Village of Big Bend to contract with the
City of Muskego for the services set forth in this
Agreement.

i 3. STATEMENT OF WORK
In furtherance of the above intentions and intending to be
mutually bound, the parties hereto agree as follows:
The Village of Big Bend shall carry out the administration
and enforcement of both the Uniform Dwelling Code and the
Wisconsin Uniform Building Code and assisting the City of
Muskego in any legal aspects of enforcement, such as hiring
expert witnesses, etc. To perform its obligations under this
contract, the City of Muskego agrees to conduct such plan
examinations and inspections using the services of inspectors
certified in the disciplines for which such inspections are
conducted. The City of Muskego further agrees that such
certified personnel will conduct all necessary and required
inspections on one- and two-family dwellings constructed in the
Village of Big Bend located in Waukesha County.
It is further agreed that, upon request by the Village of
Big Bend, the City of Muskego will make inspection reports
available on all inspections conducted.
City of Muskego shall provide additional information as may
reasonably be required by Big Bend. Such information may
include, but is not limited to, certification, representations,
statements and financial and technical reports and data.
4. SCOPE OF WORK
To perform its obligations under this contract, the City of
Muskego agrees to perform the following job functions in a
manner consistent with the provisions of Chapter Ind. 20 through
25 of the Uniform Dwelling Code.

Dwelling Code.

(4) Chapter Ind. 24 (Electrical)
(5) Chapter Ind. 25 (Plumbing
5. OFFICE PROCEDURES OF THE CITY OF MUSKEG0
A. Maintenance of records, including inspection and
financial records related to building permits.
B. The City of Muskego shall establish and maintain
adequate records of all expenditures incurred under the
contract. All records must be kept in accordance with
generally accepted accounting procedures. All
procedures must be in accordance with federal, state,
and local ordinances.
6. ASSISTING THE VILLAGE OF BIG BEND IN INSURING COMPLIANCE
The City of Muskego shall:
A. Issue noncompliance orders.
B. Make recommendation on appeals.
C. Appear as witnesses during legal proceedings.
7. PERMIT FEES
The Village of Big Bend has established permit fees by
ordinance.

15 minute travel time will be added to above figures.
If numerous inspections performed at one time, only one
trip charge will be billed.
All times will be added together including trip time and then
rounded up to the next 1/2 hr.
Example: 1/2 hr. inspection, 1/4 hr. trip time = 3/4 hr.
1 hr. will be billed.
1/4 hr. inspection, 1/4 hr. trip time = 1/2 hr.
1/2 hr. will be billed.
These times are approximate. Special circumstances may arise
and additional time may be billed beyond these figures when
necessary.
All times include filling out reports and reasonable phone time
related to inspection activities.
Administrative and clerical time for Big Bend reports, Plan
Commission or Board of Appeals research will be billed. 0

/' Board of Appeals and Plan Commission meetings, as well as any
required appearances as a witness for legal proceedings, to be
billed 3 hours minimum with any time over 3 hours billed in 1
hour increments.
All time to be billed at a rate of $35/per hour. I
9. PERIOD OF PERFORMANCE
The initial term of this contract shall be twelve months
from the effective date.
10. TERMINATION OF CONTRACT
Either party may terminate this contract at will upon
thirty (30) days prior written notfce to the other party.
11. LIABILITY
That it is hereby agreed that the Village of Big Bend will
hold harmless and/or indemnify the City of Muskego and/or any
employees, officers, or agents of the City of Muskego and
provide defense for any claim brought against the City of
Muskego and/or against any employee, officer, or agent of the
City of Muskego who is performing a function pursuant to this
Agreement.
