CCR1991076COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #16-91 SPECIAL ASSESSMENTS AGAINST BENEFITTED PROPERTY FINAL RESOLUTION LEVYING AND WAIVER OF SPECIAL ASSESSMENT NOTICES SCHULTZ LANE ROAD RECONSTRUCTION PROJECT AND HEARING UNDER §66.60(18) WHEREAS, the undersigned are all of the owners of property described below: SEE LEGAL DESCRIPTION ATTACHED HERETO AND MARKED EXHIBIT "1" and WHEREAS, the undersigned acceptors of the Resolution own the property described on Exhibit "1," which is benefitted by the Schultz Lane Road Reconstruction Project. NOW, THEREFORE, BE IT RESOLVED as follows: 1. That by executing the acceptance of the Resolution, the owners of said property also hereby waive special assessment notices and hearings under §66.60(18) and consent to the levying of special assessments against their property for the cost of said improvement under Wisconsin Statute 66.60 and question from the construction of said improvements is just further agree and admit that the benefit to the property in and reasonable. 0 2. That a special assessment is hereby levied against the following described property in the following amounts: PROPERTY BEING ASSESSED Howard H. Schultz W145 S8160 Schultz Lane Tax Key #2213.982 and 2213.983 Loreen L. Klauser S80 W14401 Schultz Lane Tax Key No. 2213.980 AMOUNT OF ASSESSMENT $17,000 $23,000 3. This assessment may be paid in cash in full on or before November 1, 1991 or in ten (10) equal annual installments of principal together with twelve (12) months interest per installment at the rate of 8% per annum conunencing on November 1, 1991. All assessments or installments which are not paid by the date specified shall be extended upon the tax roll as a delinquent tax against the property and all property for delinquency real estate taxes shall apply to proceedings in relation to the collection, return and sale of such special assessment, except as otherwise provided by statute. 0 Resolution #76-91 Page 2 4.
