CCR1991001COMMON COUNCIL - CITY OE MUSKEGO RESOLUTION 111 -91 AUTHORIZING THE EXECUTION OF MUTUAL AID POLICE AGREEMENT BETWEEN THE CITY OF MUSKEGO AND THE CITY OF FRANKLIN WHEREAS, the Cities of Muskego and Franklin are so located that it is to the advantage of each to extend aid to the others in respect to police department services, and WHEREAS, it is recognized that the use of police officers to perform police or peace duties outside the territorial limits of be desirable and imperative under certain circumstances to the municipality where such officers are regularly employed, may preserve and protect the public health, safety and welfare, and WHEREAS, the Cities of Muskego and Franklin deem mutual aid police service to be in the best interests of the community, and WHEREAS, the City of Muskego and the City of Franklin desire to participate under a mutual aid police service plan with other local municipalities according to the terms and conditions as per the attached agreement, and WHEREAS, the attached agreement has been recommended for approval by the Finance Committee. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Finance Committee, does hereby approve the execution of this Mutual Aid Agreement. Sanders CITY OF FRANKLIN CITY OF MUSKEG0 MUTUAL AID AGREEMENT AND AUTHORIZING LOCAL OFFICIALS TU PERFORM THEREUNDER AGREEMENT APPROVING MUTUAL AID POLICE SERVICE WHEREAS,the Cities of Muskego and Franklin, hereinafter referred to as "Member Municipalities," are a0 located that it is to the advantage of each to extend aid to the others in respect to police department services, and WHEREAS. it is recognized that the use of peace officers to perform police or peace duties outside the territorial limits of the municipality where such officers are regularly employed, may be desirable and imperative under certain circumstances to preserve and protect the public health, safety and welfare, and WHEREAS, the Cities of Muskego and Franklin deem mutual aid police service to be in the best interests of the community, and WHEREAS, the Member Municipalities desire to participate under a mutual aid police service plan with other local municipalities according to the terms and conditions hereinafter set forth, and WHEREAS, authority is granted to enter into a Mutual Aid Agreement as provided by Section 66.30. Wisconsin Statutes and as otherwise provided by law. NOW, THEREFORE, BE IT RESOLVED, that the Elective Governing Officials of the Member Municipalities hereby approve and enter into this agreement, by which the Member Municipalities will participate with each other in a program of mutual aid police service, subject to the following terms and conditions: 0 1. 2. Authorization - Each Member Municipality does hereby authorize and direct its police chief or the officer commanding in his absence, to render and request mutual police aid to and from other Member Municipalities to the extent of available personnel and equipment not required for adequate protection of the Member Municipality rendering aid. The judgme,nt of the police chief or officer commanding in his absence, of each municipality rendering aid. as to the amount of personnel and equipment available, shall be final. Power and Authority - Police officers, who shall be commanded by their superior authority to maintain the peace or perform police duties outside the territorial limits of the city or village which regularly employs such officers, shall be under the direction and authority of the local Commanding police officer of the municipality to which they are called to perform police or peace duties, and shall be peace officers thereof; they shall have all powers and authority of peace officers as provided by law, including the power of arrest. , . 3. Compensation - Mutual aid police service shall be rendered without charge to a Member Municipality. 4. Liability - All wage and disability payments, pension and workmen's compensation claims, damage to equipment and clothing, and medical expenses shall be paid by the city or village regularly employing such officer. 5. Rules and Regulations - The police chiefs of the Member Municipalities shall establish uniform rules and regulations for giving and receiving aid, which shall be subject to the approval of each governing body. A copy thereof shall be filed with the clerk of each Member Municipality. The rules and regulations may be revised and amended from time-to-time by the police chiefs upon their unanimous agreement, subject to the approval of each governing body, and a copy of each revision or amendment shall be filed with the clerk of each Member Municipality. 6. Effective Date of Agreement - This agreement shall become effective upon execution of duplicate originals by the respective Member Municipality Officials. The agreements shall be placed on file with the clerk of each Member Municipality. 7. Termination - The joint agreement evidenced by the filing of certified copies of agreements with the clerk of each municipality shall remain in full force and effect until such time as a municipality files with other Member Municipalities a certified notice terminating this agreement, which date of termination shall not be less than thirty (30) days after the date of filing a certified copy of such notice with the clerk of each Member Municipality. 0 BE IT FURTHER RESOLVED, that the proper authorities of the Member Municipalities are hereby authorized and directed to do and perform all that is necessary to successfully carry out the terms of this agreement. BE IT FURTHER RESOLVED, that a certified copy of this agreement shall be filed with all Member Municipalities. 0 Procedure for Requesting Mutual Aid Mutual Aid must be requested by the Chief of Police or OIC. The request shall be documented by both agencies to include: (a) Name of requester. (b) Location and nature of the incident Mutual Aid is needed at. (c) The officer's name and squad number. (d) Disposition of the assignment. If the occurrence requires further documentation, the standard department reports shall be prepared and a copy will be provided to the agency being furnished the Mutual Aid. MUTUAL AID PROCEDURE The communities of Muskego and Franklin entered into a Mutual Aid Agreement for the purpose of enhancing police resources during times of emergency occurrence which would require the need of additional police personnel for a conditions. Emergency conditions are interpreted to mean an unforeseen period of time as needed to dispel the emergency.
