CCR1989185COMMON COUNCIL - CITY OF MUSKEtiO RESOLUTION #185-89 RESOLUTION AMENDING SEWER ASSESSMENT POLICY FOR CONSTRUCTION OF SANITARY SEWERS WHEREAS, the Public Utilities Committee wishes to amend the attached Sewer Assessment Policy for Construction of Sanitary Sewers to clarify the method of determining a corner lot assessment. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Public Utilities Committee, does hereby amend 3.a.l. of the attached assessment policy to read as follows: 3.A.1. If a lot abuts two streets, add the two side dimensions and divide by two. BE IT FURTHEK RESOLVED that 3.a.2. and 3. of the attached assessment policy are hereby deleted. Sanders ATTEST : City Clerk 7/89 jz CITY OF MUSKEGO ASSESSMENT POLICY FOR CONSTRUCTION OF SANITARY SEWERS 1. The basis for sewer assessment shall be the assessable linear footage of frontage of each benefitted property within an assessment district, computed as per the following requirements. 2. Sewer assessable and non-assessable costs: A. The front foot assessment for residential, commercial and industrial zoned properties shall be based on the minimum size sewer required to serve the respective assessment of the properties within the assessment district. Sewers in district and at a depth necessary to drain (or service) all public right-of-ways and within easements shall be assessed back to the respective assessment district as directed by the City depending on the nature of the easement sewers (the reasons for obtaining the easements.) B. Assessable sewer costs shall include the total costs for the sewer mains, manholes and risers. The costs of sewage lift back to the benefitted properties based on the contributing stations, force mains, and oversized sewers shall be assessed sewage flows or population within the respective assessment district. Costs involving inspection, engineering, legal, patching and the necessary administration costs to complete restoration costs such as pavement replacement and pavement a project shall also be assessed back to the respective assessment district. C. Non-assessable costs shall include those costs for sewer tunneling, jacking of sewer in liner pipe and concrete encasement of sewers. 3. The assessable linear footage shall be determined as follows: A. For Corner lots: 1. If the sewer is installed in both streets - add the two side dimensions and divide by two. 2. If the sewer is installed in one street only and the owner is not given his option for the lateral location, use the sewered side dimension of the lot regardless of whether it is the long or short side. 3. If the owner is given his option for the lateral loca- tion and as a result of his decision along with certain design decisions for the project, the sewer is not installed on one of the sides, the assessable frontage shall be figured as per Item 1 of this section for corner lots. 0 Assessment Policy of Sanitary Sewers Page Two B. On lots with frontage on three streets - use the longest and shortest side and compute as a corner lot. C. On lots with frontage on two streets - use frontage on one street only if the lot cannot be subdivided into an addition- al lot or lots complying with the present zoning ordinance. D. For lots on cul-de-sacs, use the chord dimension at the building set-back line as measured tangent to the curve at its mid-point, if said set-back line is formed by a curved line. E. For lots on curves with an exterior angle over 45' as measured between the side lot lines of each lot, use the chord dimen- sion at the building set-back line for the inside lots on the curve. F. On large tracts of land which are on corners - assume a future corner lot that complies with the present zoning ordinance and apply the corner lot policy. The balance of the frontage shall be considered at full linear footage. Deferment of assessments for large tracts of land will be reviewed by the City on an individual basis upon a written request for defer- ment by the respective property owner. G. When a sewer passes a large tract of land that would be eligible for deferment, the homesite will be assessed for the number of feet that would be required on the minimum width required by zoning. H. Lots which do not meet the above criteria will be handled on an individual basis; as each special situation is decided, it will become policy for future decision of a similar nature. 4. Sewer laterals will be assessed back to each respective property within streets. for the entire expense on a unit or lump sum basis when installed 5. In the future, unless this policy is amended, no front foot sewer RCA charges established by Resolution #169-84 under the following assessments will be made against properties subject to future user circumstances: A. Because of the depth of the sewer or other hardship approved by the public Sewer Committee no lateral connection can reasonable be made, or Assessment Policy for Construction of Sanitary Sewers Page Three B. Because an additional sewer main will be constructed which will be the direct source of sewer service to the property from the sewer main to be constructed and that laterals will in question in that the laterals to the property will come not be connected to the sewer main for which no front foot sewer assessment will be made, or C. In any .event, if a direct connection is ever made by lateral to the sewer main for which no front foot sewer assessment has been made, a charge will be made based on the equivalent cost of installing a sewer main for a lot of equivalent width. 6. As to properties within the Reserve Capacity Assessment (RCA) District fronting on controlled access sewer lines where no lateral to said property is to be connected to said sewer lines, it is determined as follows: A. That as the future user sewer reserve capacity assessments against property determined to be subject to this resolution are paid, the amounts so paid shall be considered payment also satisfyinq the special assessment for controlled access question, which shall be completely satisfied when the reserve sewer of which no direct use is made by the property in capacity assessments paid exceed the total of said assessments including interest. B. That properties which are eligible for treatment under this resolution will be determined on a case by case basis by separate resolution. C.
