CCR1989136COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #136-89 FINAL RESOLUTION LEVYING SPECIAL ASSESSMENTS ASSESSMENT NOTICES AND HEARINGS UNDER §66.60(18) AGAINST BENEFITED PROPERTY AND WAIVER OF SPECIAL (SewerfAnn Drive - Madsen) WHEREAS, Roth Realty, Inc., hereinafter referred to as "Developer", is Lnstalling a sewer main and dedicating the same to the City of Muskego, and WHEREAS, the undersigned acceptors of this Resolution own the following described property which is benefited by said sewer installation, and MSKC 2195.931 m-9 T5N R20E COM S1/4 COR W213.18 FT N9 37' 370.69 FT W 310.12 FT N4 0'-E 370.74 FT N30 40'W 250.76 FT S67 27'W 112.11 FT THE BGN 567 27'W 120 FT N36 01'W 205.64 FT N67 27'E 170 FT S21 57'E 200 FT TO BGN & R/W R374/315 WHEREAS, the City of Muskego wishes for the Developer to install and pay for the entire sewer main (the City of Muskego to pay the Developer the portion of cost represented by the amount of below assessment) and dedicate the same to the City of Muskego. NOW, THEREFORE, BE IT RESOLVED as follows: 0 1. That be executing the acceptance of this Resolution as special assessment notices and hearings under §66.60(18) and stated below, the owners of said property also hereby waive consent to the levying of special assessments against their property for the costs of said improvement under Wisconsin Statute $66.60 and Eurther agree and admit that the benefit to the property in question from the construction of said improvement is just and reasonable. 2. That a special assessment is hereby levied against the property stated above in the amount of $2,155.20 (front foot) plus $1,126.97 (lateral) for a total due of $3,282.17. before November 1, 1989 or in ten (10) annual installments to 3. That the assessment may be paid in cash in full on or the City Treasurer, installment payments to bear interest at November 1, 1989 and said first installment being due on the the rate of 8% per annum onthe unpaid balance commencing on date when real estate taxes are due and annually thereafter. All assessments or installments which are not paid by the date specified shall be extended upon the tax roll as a delinquent tax against the property and all proceedings in re.lation to the collection, return and sale of property for delinquent except as otherwise provided by statute. real estate taxes shall apply to such special assessment, - Resolution 11136-89 Page 2 4.
