RESOLUTION 111 12-89
APPROVAL OF LEASE
(Idle isle Park Pavilion)
BE IT RESOLVED that the Common Council of the City of Muskego,
upon the recommendation of the Parks and Recreation Board and
the Finance Committee, does hereby approve the attached
"Assignment, Acceptance and Consent" agreement between Keith
and Wendy Bennett, Donald Collins and the City of Muskego
regarding the lease of the Idle Isle Park pavilion.
RE IT FURTHER RESOLVED that the Mayor and Clerk are authorized
to execute the necessary documents in the name of the City.

ASSIGNMENT, ACCEPTANCE AND CONSENT
Tenants hereby assign all Tenants' right, title and interest
in and to the Lease from the City of Muskego to Keith and Wendy
Bennett dated the " 14th day of April , 1987, as to a
portion of the Idle Isle Park Pavilion, more specifically
described in said Lease, to Donald Collins
and in consideration of the consent to the assignment by Landlord,
Tenants guarantees the performance by said Assignee of all
obligations of Tenants.
In consideration of the above assignment and the written
consent of Landlord, Assignee hereby assumes all obligations of
Tenants in the lease and the other obligations stated above and
agrees as follows and Tenants also agree as follows in
consideration for Landlord consenting to this Assignment:
1. The section of the Lease entitled "RENEWAL" is hereby
deleted from the Lease.

2. The section entitled "COVENANTS OF CITY OF MUSKEGO"
"No other concession privilege shall be granted
during the remainder of this Lease on Idle Isle
Island except for Lakefest."
3. The Lease terminates on September 30, 1989.
LANDLORD HEREBY CONSENTS TO THIS ASSIGNMENT AND ACCEPTANCE.
IN WITNESS WHEREOF, the parties have executed this Assignment
and Acceptance on the day of , 1989.
