D!ZVELOPMENT LANDFILL NFGOTIATED AGRm APPROVAL OF AMEND= To FUTURE PARKIAND
WHEREAS, the Comn Council approved the Future Parkland Development Landfill
Negotiated Agreement in Resolution N24-86 on June 10, 1986, and
WHEREAS, Future Parkland Development has requested to extend their Saturday
hours, and
WHWEAS, the Plan Cmission has recomended that the limitation that the site
shall not be opened on Saturdays more than twenty (20) times each year be
deleted from the negotiated agreement.
NCM, THENCEORE, BE IT RESOLVED that the Comn Council upon the recomndation
of the Plan Conmission does hereby agree to amend the specific provisions of
the final negotiated agreerent for Future Parkland Development Landfill as
follows:

12. B. The Landfill Operator shall only operate (“operate” shall include
6:OO P.M., Monday thrmgh Friday, and from 9:OO A.M. and 2:OO P.M. on
occasional Saturdays, not to include remval of clay soils. The site
shall not be open on Saturdays mre than twenty (20) times each year.
The Landfill Operator shall notify the City Clerk prior to opening on any
Saturday, by 3:OO P.M. of the last working day before such Saturday
opening. Except that in the calendar year 1988 the landfill may be
operated 52 Saturdays rather than the twenty (20) stated above and that
in all years after 1988, unless further amnded, Future Parkland
Development Landfill shall operate only twenty (20) Saturdays as stated
above with extensions considered on a year-by-year basis; there shall be
a fee of $50.00 per Saturday in 1988 for each Saturday the Landfill is
operated in excess of 20 Saturdays and said fee for 1988 shall be paid on
or before Decenber 31, 1988.
BE IT FURTHER RESOLVED that the Comn Council does hereby agree to amend the
negotiated agreement for Future Parkland Development Iandfill as stated above
to be effective upon written acceptance of this by Future Parkland Development
within thirty (30) days of the passage of resolution or this resolution is
null and mid.
