CCR1988129COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION 11129-88 AUTHORIZE EXECUTION OF AGREEMENT BETWEEN WASTE MANAGEMENT OF WISCONSIN, INC. AND THE CITY OF MUSKEG0 REGARDING SEWER SERVICE WHEREAS, Waste Mangement of Wisconsin, Inc. and the City of Muskego are in the process of negotiating an Agreement regarding use of the City's sewer facilities, and WHEREAS, the attached interim Agreement would allow for the reimbursement to the City from Waste Management for all fees incurred during the preparation of the final agreement, and Waste Management before entering into the final agreement. WHEREAS, it is possible that certain changes may be required by NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego upon the recommendation of the Public Utilities Committee does hereby authorize the Mayor and Clerk to execute the attached agreement or an agreement containing similar provisions if Waste Management requires changes which the Mayor and Clerk believe are in the best interest of the City. 0 DATED THIS 24 DAY OF May 9 1988. Repischak .. . ."* AGREEMENT WHEREAS, WASTE MANAGEMEST OF WISCONSIN, INC., hereinafter referred to as "WASTE", and the CITY OF MUSKEGO, hereinafter referred to as "CITY", are in the process of negotiating an agreement for WASTE to make certain use of the CITY'S sewer facilities: and WHEREAS, both parties wish for negotiations to proceed as rapidly as possible towards a proposed agreement for sewer service to WASTE: and WHEREAS, the CITY will from this date forward incur engineering fees, attorney fees and similar fees in an attempt to proceed towards development of an agreement between the CITY and WASTE; and WHEREAS, WASTE will reisburse the CITY for said sums. NOW, THEREFORE, for valuable consideration acknowledged by both parties, IT IS AGREED AS FOLLOWS: 1. That on or about a monthly basis, the CITY shall submit to WASTE all reasonable engineering, legal and similar costs incurred in development of the proposed project and WASTE will pay the sane immediately on receipt of said bills; and 2. If a successful contract is negotiated between WASTE and the CITY, WASTE shall then and there be credited against its contribution to said project in an amount equal to said fees incurred after the date of this agreement; and 3. If such a contract is not negotiated within one (1) year from the date of this agreement, WASTE shall have paid said fees with no reimbursement from the CITY. Dated this day of , 1988.
