CCR1988048COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION 1/48-88 (As Amended) RESOLUTION AS TO ASSESSMENT OF GREGORY BOEHM PROPERTY (Lannon Dr. Water Project MW-4-87 - Assessment District WC) WHEREAS, the City of Muskego adopted Resolution 11175-86, As Amended, establishing a Deferred Assessment Policy as to water, said policy being amended by Resolution 11266-86; and WHEREAS, the City of Muskego wishes to negotiate, pursuant to said policy, a payment of less than the entire assessment upon improvement, which was levied by Resolution 1/46-87 of only a portion of said property; and WHEREAS, Gregory J. Boehm, Gloria J. Boehm, Pamela Boehm Rieder Gary'B. Boehm and State Bank Hales Corners are all of the owners and/or mortgage holders of said property and wish to negotiate concerning said assessment which affects the property legally described as follows: Tax Key No. 2218.986, Assnt. Th S 89O 45 W 222.6 Ft To Bgn 4.998 RE1521209 WD 1/87 WHEREAS, the Public Water Committee has recommended approval of a proration of the water assessments as follows: The assessable prorated against the lots abutting the improvements, thus road frontage, plus any water main extension costs, will be with the property. Assessments will be paid at 125% of their removing the assessment from the balance of the lots involved proration. The laterals will continue to be paid on a two year payment plan and the unpaid balance, per lot, will be paid upon year plan. The prorated lot assessments will be due and payable sale, if the sale is prior to when it would be due under the two at the end of five years, if not paid prior to that time. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Muskego that special assessments for water improvements levied upon the 48 lots approved in the Final Plat of Meadow Green on June 23, 1987, and other lands described above, shall become due and payable as follows: I- ,. .-:* : Resolution 1/48-88 (As Amended) Page Two 1. That upon sale of any of the 15 lots abutting the improvement on Lannon Drive and Woods Road, a front foot assessment of $2,528.51, plus interest at 8% per annum on the unpaid balance from November 1, 1987, is due and payable, and if not paid shall be extended on the tax roll and collected as a delinquent real estate tax; however, in any event, all such front foot assessments are due five levy which is Resolution 1/46-87 dated March 31, 1987. All rovisions of Resolutions 11175-86, As Amended, 11266-86 and 7 146-87 shall apply to the property described in the Final Plat and this agreement shall be null and void unless by April 1, 1988 all of the following events have occurred: A. Gregory J. Boehm, Gloria J. Boehm, Pamela Boehm Rieder, Gary B. Boehm and State Bank of Hales Corners as all of the owners of the land in question execute this resolution as their agreement; and Rieder, Gary B. Boehm and State Bank of Hales Corners B. Gregory J. Boehm, Gloria J. Boehm, Pamela Boehm execute any additional agreement necessary to record this document; and Rieder, Gary B. Boehm and State Bank of Hales Corners give C. Gregory J. Boehm, Gloria J. Boehm, Pamela Boehm the City evidence satisfactory to the City that they are sole owners of all the property in question at the time of acceptance of this resolution and have the right to enter this agreement; and Rieder, Gary B. Boehm and State Bank of Hales Corners D. Gregory J. Boehm, Gloria J.
