AUTHORIZING SETTLEMENT OF SUPER EXCAVATOR CLAIM
LADWIG DRIVE PROJECT
WHEREAS, Super Excavators filed a claim against the City for
$63,766.38 together with interest from May 22, 1986 relating to
the Ladwig Drive Sewer Project, and
WHEREAS, a payment of $14,821.45 has been made, leaving a balance
of $48,944.93, plus interest, and
WHEREAS, the City Attorney has negotiated with Super Excavators
to settle the claim for $37,000.00, and
WHEREAS, the Finance Committee has recommended approval.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance Committee, does hereby agree to settle the Super Excavator claim
for $37,000.00.
BE IT FURTHER RESOLVED that the Mayor and Clerk are authorized to
sign any legal documents in the name of the City.
