AUTHORIZING EXECUTION OF SPECIAL ASSESSMENT AGREEMENT
BETWEEN CITY OF MUSKEGO AND ROBERT KLENZ
WHEREAS, the Public Water Committee and the Finance Committee
Muskego and the owners of the property with Tax Key No. 2198.985
have recommended that an Agreement be drafted between the City of
to include the following terms:
1. The front foot assessment, plus interest from November
1, 1987, shall be prorated so only that portion on
certified survey map No. 5285 shall be paid by the owner
at this time, or if not possible, owner shall pay the
entire assessment and agree to a new deferred assessment
on the portion not included in CSM 5285 with that part
of the assessment being reimbursed to the City.
2. That portion of the front foot assessment on the 60 ft.
frontage of Parkland Dr. Extended on Hwy. 24 shall be
divided equally between the City of Muskego and the
Owners of Tax Key No. 2198.985 because of the benefit to
owners of Tax Key No. 2198.985 to pay the assessment in
the City-owned property for park purposes, with the
full, with 50% to be refunded by the City, from the Park
Dedication Account.
3. The water lateral assessment, plus interest from
November 1, 1987, will be divided with the owners of Tax
Key. No. 2198.985 to pay 1/3 of the cost and the City of
Muskego to pay 2/3 of the cost because the lateral will
serve the City park land property and the Tax Key. No.
2199.999 property. This reimbursement will be paid by
the Water Utility account.
4. The balance of the assessment shall be paid subject to
the water deferral assessment policy of the City.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Public Water
Committee and the Finance Committee does hereby direct the City
Attorney to draft the Agreement as recommended above.
BE IT FURTHER RESOLVED that the Mayor and Clerk are authorized to
execute said Agreement in the name of the City.
