CCR1987263\ / COMMON COUNCIL - CITY OF MUSKEG0 RESOLUTION #263-87 RESOLUTION WITHDRAWING APPROVAL OF THE STORMWATER DRAINAGE AND FLOOD CONTROL POLICY PLAN FOR THE MILWAUKEE METROPOLITAN SEWERGE DISTRICT WHEREAS, this Common Council adopted Resolution No. 74-87 on April 28, 1987 approving the STORMWATER DRAINAGE AND FLOOD CONTROL POLICY PLAN FOR THE kfILWAUKEE METROPOLITAN SEWERAGE DISTRICT (C S8 ommunitv Assistance Plannine Reoort No. 130 of the - outheastern Wisconsin Regional Planning Commission) (the "Policy u - .. I Plan") ; and WHEREAS, said approval was made expressly contingent upon the appointment of not less than three (3) representatives of that portion of the study area not presently located within the boundaries of the Milwaukee Metropolitan Sewerage District (MMSD) to the Advisory Committee on Stormwater Drainage and Flood Control Planning; and WHEREAS, the MMSD has refused to make said appointments; and WHEREAS, the City of Muskego recognizes the need for and supports the development of a Stormwater Drainage and Flood Control Plan for the area but has serious concerns about the implementation program that will be developed under this plan and the impact of this program on the City of Muskego. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Muskego that the contingent approval given to the Policy Plan under Resolution No. 74-87 is hereby withdrawn. BE IT FURTHER RESOLVED, however, that as set forth in Resolution No. 74-87, the City of Muskego calls upon the MMSD and the Southeastern Wisconsin Regional Planning Commission to addess in a straight-forward basis the concerns of the City of Muskego that: 0 - the forthcoming implementation plan must recognize that sanitary sewer service and storm drainage are separate issues, and any assumption that drainage and flood control costs can be distributed on the same basis as sanitary sewer service costs is questionable; - the costs of implementation of the Policy Plan be distributed on a fair and equitable basis to - all communities in the drainage area; 0 - inclusion within the MMSD boundaries as a criteria for project eligibility is inappropriate and, in fact, unrelated to the proper implementation of the Policy Plan ; Page TWO Resolution #263-87 - the implementation plan could result in broadening the jurisdiction of the MMSD, the DNR, or other agencies over matters now under the jurisdiction and control of the City of Muskego. BE IT FURTHER RESOLVED that copies of this Resolution be sent to District and the Southeastern Wisconsin Regional Planning the appropriate officials at the Milwaukee Metropolitan Sewerage Commission.
