SALENTIN JJJ VETO MESSAGE Amend Zoning Text and Rezone Property to Transitional Agriculture I have made the decision to veto Resolution #196-87, Petition to Common Council meeting held September 22, 1987, after conferring Zoning, which was adopted by a vote of 4 "yes" and 2 "no" at the with City Attorney Molter and Dave Fodroczi, Farmland Preservation Office. It was determined that assessments could not be levied against Transitional Agriculture Zoning. The City does have the prerogatve to rezone property at the City's discretion but then the City becomes liable for credits that the property is liable for over a ten year period, subjecting the Utility to not have the ability to assess for improvements and a potential for credits that a propety has received is not in the best interest of the Utility. I do not foresee your action of upholding this veto as ruling out but I do believe that the Plan Commission and Common Council the option of certain properties to participate in the program, should react to those requests on a per parcel basis. a WGS/ca cc: City Clerk Plan Commission
