BETWEEN THE CITY OF MUSKEGO AND THE KRISTIN DOWN WATER TRUST
DIRECTING THE CITY ATTORNEY TO DRAFT AN AGREEMENT
AND THE ENGINEERS TO REPORT ON VALUE OF THE SYSTEM
WHEREAS, the Kristin Down Water Trust is interested in becoming a
part of the City's Water Utility, and
WHEREAS, it is necessary to enter an Agreement between the City
and the Kristin Down Water Trust to allow said system to become a
part of the City's Water Utility, and to obtain a report on the
value of the system.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego does hereby direct the City Attorney to prepare
allow said system to become a part of the City's Water Utility.

BE IT FURTHER RESOLVED that the City Engineers are hereby
directed to prepare a report on the value of the Kristin Down
water system.
BE IT FURTHER RESOLVED, as recommended by the Finance Committee,
that as connection between the trust water system and the
municipal water system is likely and that contractors for the
Clerk are authorized to enter into the attached agreement for City are now doing water work within the City, the Mayor and
construction of a pipe from the municipal system to the trust
system for a cost not to exceed $3,500.00, with funds from the
Water Utility account.

AGREEMENT
WHEREAS, the KRISTIN DOWN HOMES ASSOCIATION, INC., hereinafter
referred to as "ASSOCIATION", is the owner of a certain water
system within the City of Muskego, and
WHEREAS, the undersigned Board of Directors are specifically
and
authorized to enter this Agreement on behalf of said ASSOCIATION,
WHEREAS, the CITY OF MUSKEGO, hereinafter referred to as "CITY",
wishes to construct a water line up to the water lines owned by
said ASSOCIATION, and
WHEREAS, the parties wish to inter-connect their pipes, but to
have a valve so that their systems remain separate until such
would make the ASSOCIATION part of the Municipal Water System.

NOW, THEREFORE, BE IT RESOLVED, for valuable consideration
acknowledged by each party, that the CITY may, if it so desires,
construct, at its sole cost and expense, a water pipe which
touches upon the water pipes owned by the ASSOCIATION, but
keeping the system separate by way of a valve; that the
ASSOCIATION specifically consents to said construction; that the
systems shall not become connected until such time as a further
agreement may be reached between the parties as to make the
ASSOICATION a part of the Municipal Water System.
