AUTHORIZING EXECUTION OF AGREEMENT BETWEEN CITY OF MUSKEGO
AND GOLF CLUBS OF AMERICA, INC. REGARDING FEASIBILITY
OF SEWERS FOR PROPOSED DEVELOPMENT
BE IT RESOLVED that the Common Council of the City of Muskego,
upon the recommendation of the Finance Committee, does hereby
authorize the Mayor and Clerk to execute the Agreement attached
hereto providing for the payment of $30,000 by Golf Clubs of
America, Inc. to the City for the purpose of developing a
facility plan to determine the feasibility of sewering of the
area proposed for development, subject to confirmation by Ruekert
h Mielke that the costs would not exceed $30,000.

WHEREAS, GOLP CLUBS OF AMERICA, IUC., hereinafter referred
described on Exhibit '1' which is attached hereto and made a part to as 'GOLFg, have expressed an interest in developing the area
hereof: and
WHEREAS, the CITY OF MUSKEGO, hereinafter referred to as
'CITY., has expressed an interest in the concept of such a
development; and
WRREREAS, if said area is to be developed, it is contemplated
that the development would take place only if municipal sewer
services were available; and
WHEREAS, it is agreed between the parties that in order to
determine if municipal sewer services are feasible at this time
to serve the area described on Exhibit '1- and the surrounding
area, that a facility plan must be developed.

NOW, TEEREFORE, for valuable consideration acknowledged by

That upon execution of this Agreement, GOLF shall pap to
the CITY the sum of $30,000 and that said $30,000 shall
be expended only for the purpose of making payment to
the City Engineering firm of Ruekert 6 Hielke. loc. and
any other entities they may deem appropriate for the
purpose of developing a facility plan to determine
whether or not the sewering of the area described on
Exhibit 'I' and surrounding area is feasible.
That the CITY shall pay all statements of Ruekert &
Hielke, Inc, and/or other entities that Ruekert &
Hielke, Inc. may deem appropriate for work on said
project as they become due and if any monies remain
afcer payment of all the fees arowing out of the
aevelopment of said plan out of the $30,000, the
remainaer shall be reimbursed to GOLP: GOLF shall
not be responsible for any costs in excess of $30,000
for the development of said plan.
