[CITY-OWNED LOT OFFER-WOODLAND PLACE (Runge)]
AUTHORIZATION TO RETAIN EARNEST MONEY
WHEREAS, the Council accepted an Offer to Purchase from Mr. and
Mrs. Ronald Runge dated 2/28/87 on 3/10/87, and
WHEREAS, the Runge's submitted a Cancellation Agreement and
Mutual Release on 5/8/87, requesting disbursement of the $500.00
earnest money, and
WHEREAS, a subsequent Offer to Purchase from Roger Kastello dated
5/11/87 was rejected by the Council on 5/12/87, and a Counter-
Offer was authorized, with the earnest money to be returned to
the Runge's upon acceptance of the counter offer, and
WHEREAS, said counter-offer was not accepted, and
WHEREAS, the Finance Committee has recommended that the $500.00
earnest money be retained as liquidated damages.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance
Committee, does hereby authorize the City Clerk to notify the
broker and buyer that the City has elected to consider all money
paid hereto as liquidated damages or part payment for specific
performance.
