APPROVAL OF TERMS FOR REMOVAL OF TOPSOIL (As Amended)
FREDERICKS SOIL CO. (Industrial Park Addn. No. 1)
WHEREAS, all quotes for the removal of stockpiled topsoil in the
Industrial Park Addn. No. 1 were rejected by Resolution #298-86
and the Finance Committee was directed to negotiate with
Fredricks Soil Co., Inc., who had submitted the high quote, and
WHEREAS, the Finance Committee has recommended approval of the
following proposed terms:
1. $50,000 for the approximately 38,000 cu. yd. stockpiled
2. Payment to be received as follows:
topsoil €or removal by August 1, 1988.
a. $12,500 by March 1, 1987
b. $12,500 by September 1, 1987
c. $12,500 by March 1, 1988
d. $12,500 by August 1, 1988
guaranteeing payment of $37,500.
3. Fredricks Soil Co., Inc. will supply a Letter of Credit
4. Culvert is to be provided by the City.
5. Gravel to cover culvert will be supplied by Fredricks
6. Haul road will be limited to Saturn to Racine.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance Committee
does hereby approve the sale of the stockpiled topsoil in the
Industrial Park Addn. No. 1 to Fredricks Soil Co., Inc. subject
to the terms set forth by the Finance Committee as listed above.
BE IT FURTHER RESOLVED that this is an approval in concept only
Clerk of a written contract prepared by the City Attorney which
and final approval will be given upon execution by the Mayor and
sets forth the terms.
