AMENDED PRELIMINARY RESOLUTION DECLARING INTENT TO EXERCISE
SPECIAL ASSESSMENT POLICE POWERS UNDER §66.60, WISCONSIN
STATUTES, AS TO WATER IMPROVEMENT ASSESSMENT AREA FOR
PROJECT nw. 24, LANNON TO BAY LANE
RESOLVED by the Common Council of the City of Muskego,
Wisconsin:
1. That this Resolution amends Preliminary Resolution (1182-
86 which was passed and approved on 8/26/86.
2. The Common Council hereby declares its intention to
exercise its police power under 566.60, Wisconsin Statutes, to
described area for special benefits conferred upon such property
levy special assessments upon property within the following
by installation of the water improvements in streets abutting the
following property:
For Project HWY. 24, Lannon to Bay Lane
Water Improvement Assessment Area

3. The Common Council determines that the improvements
constitute an exercise of the police power and the amount
assessed against each parcel shall be based on front foot.
4. The assessment against any parcel may be paid in cash or
in annual installments.
5. The City Engineer shall prepare a report which shall
consist of:
A. Final plans and specifications for the improvements.
B. An estimate of the entire cost of the proposed water
improvement project.
C. Schedule of proposed assessments.

proposed improvement, the general boundary lines of the proposed

be published as a Class I Notice and a copy shall be mailed at
least ten (10) days before the hearing to every interested party.
8. Some of the proposed assessments may or may not be
deferred by further action of the Common Council.
9. The hearing shall be held at City Hall at a time set by
the Clerk in accordance with §66.60(7), Wisconsin Statutes.

WATERNAIN ASSESSMENT AREA
IN JANESVILLE ROAD FROM LANNON DRIVE TO BAY LANE
All that part of the Northwest 1/4, Southwest 1/4 and
Northeast 1/4 of Section 10, Town 5 North, Range 20 East,
City of Muskego, Waukesha County, Wisconsin, bounded and
described as follows:
All those properties that abut the right-of-way of Janesville
Road (S.T.H. 24) commencing at the intersection of
centerlines of Janesville Road (S.T.H. 24) and Lannon Drive;
thence Northeasterly along the centerline of Janesville Road
of centerlines of Janesville Road (S.T.H. 24) and Bay Lane,
(S.T.H. 24) to a point 200 feet Northeast of the intersection
said point being the point of termination.
