DENIAL OF REQUEST FOR EXTRACTIVE PERMIT

WHEREAS, Creative Resource Ventures, Ltd. has requested an
property in the NE and NW 114 of Section 36, and
extractive permit for the removal of clay from the Weseljack
WHEREAS, a public hearing has been held, and
WHEREAS, the Plan Commission has defeated a resolution to
approve the removal of clay from said property.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Plan
Commission, does hereby deny the request of Creative Resource
Ventures, Ltd. for an extractive permit for the removal of clay
from the Weseljack property in the NE and NW 1/4 of Section 36
Muskego for the following reasons:

Restoration of the property for continued used as
Agricultural property could not be guaranteed.
The Wind Lake Management District objects to this
project because it has the potential to adversely affect
the surrounding area through the watershed.
The City of Franklin objects to this project due to
concerns about the ultimate use of this parcel, where
the material to be extracted will be taken, and the
trucks filled with clay driving through the City of
Franklin could cause additional dust problems.
Residents in attendance at the public hearing voiced
objection to the project based upon concern for clean
air, odors, debris, increased traffic and creating a
potential for property value decline.
