INDUSTRIAL PARK EXPANSION SEWER AND WATER MAIN PROJECT
COLLECTION OF LIQUIDATED DAMAGES
(Globe Contractors)
WHEREAS, the completion date for the Industrial Park Expansion
Sewer and Water Main Project by Globe Contractors was May 20,
and weather conditions, which is 50 calendar days beyond the
1986, due to the late start caused by the delayed DNR approval
completion date of March 31, 1986, and
WHEREAS, the City Engineers have calculated that the deduction
day for this time period would be $12,500.00.. and recommended
for liquidated damages in the amount of $250.00 per calendar
of Item 3 of the Mandatory Alternate Bid Items being completed
that the City take a credit of $1500.00 due to only a portion
relating to the flushing of only a portion of the trenches, and
WHEREAS, the Finance Committee has recommended not to invoke
the liquidation clause, and, take a credit of $1500.00 as
recommended by the City Engineers.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego, upon the recommendation of the Finance
Committee, does hereby direct the City Engineers not to invoke
only a portion of Item 3 of the Mandatory Alternate Bid Items
the liquidation clause, and, take a credit of $1,500.00 since
were completed relating to the flushing of only a portion of
the trenches.
