RESOLUTION PROVIDING FOR THE CONTINUED SUPPORT OF FLOW
WHEREAS, the Common Council has previously adopted Resolutions
#227-82, #132-83(As Amended), #303-83, #128-84 and #231-85
providing for its participation in FLOW and committing
financial support therefor, and
WHEREAS, the Public Sewer Committee has reviewed the request
from FLOW for a $21,000 contribution and has recommended
approval.
I NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Public Sewer
Committee, does hereby approve the payment of Muskego's
contribution of $21,000 to the financial agent for FLOW.
BE IT FURTHER RESOLVED that funds for this expenditure shall be
obtained from the Sewer Utility.
BE IT FURTHER RESOLVED that the check may be submitted to FLOW
subject to: 1) If legal counsel determines it is in the best
interest of the City to pursue Muskego's case against MMSD and
FLOW will support that action, or 2) If legal counsel
determines Lt is not in the best interest of the City to pursue
the case. If in the case of 1) above FLOW does not wish to
support the City's action, payment of the check shall be
deferred for further review at the next Council meeting.
