CCR1984128RESOLUTION 8128-84 RESOLUTION PROVIDING FOR THE CONTINUED SUPPORT OF FLOW WHEREAS, the City of Muskego, along with certain other form "FLOW" which stands for Fair Liquidation of Waste in an communities bordering on Milwaukee County have joined together to effort to obtain flow-based service agreements with the Milwaukee Metropolitan Sewerage District (the "MMSD") and to promote a by the MMSD; and flow-based system of capital recovery for all Communities served WHEREAS, the Common Council has previous adopted Resolutions il227-82, #132-83(As Amended) and #303-83 providing for its participation in FLOW and committing financial support therefor; and WHEREAS, FLOW has proceeded to engage in various matters in order to promote the FLOW concept and protect the interest of FLOW Communities including: a. b. C. d. e. f. g. Retention of a professional staff of engineering, financial, legal, lobbying, and public relations consultants and employing a coordinator for the project, Development of a comprehensive computerized data base for all communities served or to be served by the MMSD to be utilized in analyzing the impacts of converting to a flow- based system for all of said communities, boundary redefinition which, if left unchallenged, could Commencement of litigation to challenge the MMSD rules on MMSD boundaries, lead to the annexation of the FLOW Communities into the Development of comprehensive national survey data supporting the FLOW concept, Development of a legislative plan to further the FLOW concept, Development of community profiles from the computerized data base to show specific impacts of converting to a flow-based system on a particular community including residential and non-residential impacts, and Development of a public relations plan to bring the FLOW concept to each of the communities served by the MMSD, the private sector and the general public. WHEREAS, these efforts over the past eighteen (18) months have WHEREAS, despite the support of the FLOW Proposal, the MMSD lead to wide-spread community support for the FLOW Proposal; and Commission continues to be staunchly opposed to the FLOW Proposal and even refuses to support an objective, outside study of capital cost allocation alternatives; and WHEREAS, because of the growing support for the FLOW Proposal, JOBS, Inc., a coalition of "wet industries" with vast financial arguing for the retention of the present ad valorem method; and resources, has formed to oppose FLOW and join with the MMSD in WHEREAS, the callous approach which the MMSD has taken toward the FLOW Proposal appears to be leading the matter into the courts for resolution rather than resolving the matter through sensible discussions and meaningful negotiations which FLOW has repeatedly endorsed and promoted; and WHEREAS, in consideration of all of the above, it is necessary for the FLOW Communities to demonstrate their steadfast and continued financial support of the FLOW effort; and WHEREAS. it is important to demonstrate that the FLOW Communities are committed to protecting their legal rights in court if necessary; and WHEREAS, following a strong cost containment policy, it is estimated that the sum of $400,000 is needed for these continued efforts and additional sums may be required in the future.
