APPROVAL OF AGREEMENT (Behrs)
WHEREAS, Jeff A. Behrs and Doris Behrs have been ordered by the
Waukesha County Health Department to correct a faulty on-site
sewage disposal system at W165 S8266 Kurtze Lane; and
WHEREAS, this corrective order would require a holding tank
agreement to be executed by the City of Muskego; and
WHEREAS, the Common Council determined on 10/25/83 that no
holding tanks would be approved in the Kurtze Lane area because
of the impending sewers; and
WHEREAS, a contract has been negotiated with MMSD which gives
be expanded, with the scheduled date for hook-up to MMSD to be
increased capacity to the City allowing the sewer service area to
December 31, 1984; and
WHEREAS, Kurtze Lane is in an area to be served by sewers due to
the need in that area; and
WHEREAS, approval of the engineering plans for sewering Kurtze
Lane has been given by MMSD as well as the DNR; and
WHEREAS, the November 9th meeting of the Public Sewer Committee
will review the bidding process for the installation of the
Kurtze Lane sewers; and
WHEREAS, in order to resolve this matter it is necessary that the
City and Jeff and Doris Behrs become parties to a Stipulation as
attached; and
WHEREAS, the Stipulation requires in part that the City guarantee
that the septic system at said premises will be maintained in
such a manner as to prevent sewerage from flowing on the surface
of the ground or in any other manner creating a public nuisance
or public health hazard, and will cause said system to be
such action as is necessary including pumping, to correct said
inspected immediately upon receiving any complaint, and will take
situation; and
WHEREAS, in order to guarantee that this requirement is
fulfilled, a $1,000 bond shall be posted by Jeff and Doris Behrs.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Muskego does hereby authorize the Mayor to sign the
Stipulation attached hereto and made a part hereof after receipt
of a $1,000 Bond from Jeff A. and Doris Behrs to assure
compliance with the Stipulation regarding the property at W165
S8266 Kurtze Lane in the City of Muskego.
BE IT FURTHER RESOLVED that the City in executing the Stipulation
interprets Paragraph No. 4 of the Stipulation to mean that
Municipal Sewers will be available to said premises.
