CCR1983268YI RESOLUTION #268-83 (As Amended) WAIVING THE RIGHT OF THE CITY TO PURCHASE PARCEL OF LAND FOR SALE BY T. BUSS (Muskego Business/Industrial Park) WHEREAS, the Rules and Regulations for the Industrial Park require that in the event any purchaser of land from the City elects to sell any portion thereof, the same shall first be offered for sale to the City, and WHEREAS, Gemini Partnership owns property at S81 W18510 which is now vacant to Wayne Borchardt for construction of Gemini Drive and desires to sell a portion of said property a building prior to'the end of 1984, and has requested the City to release its purchase option. THEREFORE, BE IT RESOLVED that the Common Council of the City of Muskego, upon the recommendation of the Finance Committee, attached Release of Purchase Option relating to the does hereby authorize the Mayor and Clerk to execute the Gemini Partnership property at 581 W18510 Gemini Drive (Lot 7, Block 2) in the Industrial Park. Mitchel Penovich ATTEST City Clerk /- RELEASE OF PURCHASE OPTION 8 WHEREAS, the Gemini Partnership owns property at S81 W18510 Gemini Drive in the Industrial Park in the City of Muskego, the legal description of which is Lot 7, Block 2, Muskego Industrial Park, a subdivision of part of the NW 1/4 of Section 16 and NE 1 /4 of Section 17, Town 5 North, Range 20 East, City of Muskego, Waukesha County, Tax I r E, Key NO. 2221 . 01 6, and WHEREAS, the Gemini Partnership has constructed a build- ing cx1 a portion of said lot pursuant to the original purchase agreement of Asril, 1974 and WHEREAS, the Gemini Partnership now desires to sell a por tion 3f said vacant land to a third party and has requested the City of Mus,kqo to release any interest that it may have pursuant to among othe- documents, the rules and regulations for Muskego Business / In- dustrial Park, in particular no. 13 of said document and WHEREAS, the City of Muskego has been advised tht the third party purcbser intends to construct a building cn the property prior to the end of 1984 and WHEREAS, the Gemini Partnership has no immediate plans for the development of said vacant land and that said land would remain taxed only as vacant land by the City of Muskego as opposed to being taxed as vacant land and improvements. NOW, THEREFORE, It is hereby agreed by the City of Muskego by its duly designated agents that the city do= hereby release and waive any purchase rights that it may have under the original offer to purchase, rules and regulations for Muskego Business/Industrial Park and any other documents as said right pertains to Lct 7, Block 2, Muskego Industrial Park, provided that the purchaser of said property shall commence con- struction of a building on said real estate no later than December 31, 1 B 1984.
