CCR1983138RESOLUTION #138-83 AUTHORIZING EXECUTION OF LEASE AGREEMENT BETWEEN RICHARD SCHAUMBERG AND MUSKEG0 PARKS AND RECREATION BOARD BE IT RESOLVED that the Cormnon Council of the City of Muskego, upon the recommendation of the Finance Committee, does hereby approve of the attached lease agreement between Richard Schaumberg and the City of Muskego Parks and Recreation Board. Mitchel Penovich ATTEST: City Clerk x* - LEASE THIS AGREMENT is made between the City of Muskego, The property which is the subject of this lease is Park Recreation Board, Lessor, and Richard Schaumberg, Lessee: described as follows, to-wit: a Lands donated to city for park purposes in Freedom Square - Phase IV RENTAL: The rental for said property shall be the sum of $180.00 for a term of one year, commencing on the 1st day of ,eune, 1983, and ending the 31st day of May, 1984. PURPOSE OF LEASE: The Lessor leases the premises and the Lessee agrees.to use the premises for the grazing and pasturing of horses owned by the Lessee, but never shall the number of horses on the leased premises be more than four (4) at any one time. The Lessee shall also use the premises for the purpose of recreation connected with the horses and for himself and family and guests and shall never use the premises or the horses for commercial purposes on the premises. CONDITIONS: Lessee shall prior to the use of the material and type of which shall be approved by the Lessor and ' premises as above described and stated, erect fences, the which shall be sufficient to keep the horses within the confines of said fences. Any gates provided to the premises shall be secured erepair of said fences at all times. Any fences or other equipment by locks and Lessee shall be responsible for the maintenance and used by the Lessee during the term of the lease or a renewal thereof shall at the option of the city be removed by him at the expiration thereof .~ LIABILITY INSURANCE: Lessee, shall, at his own expense, at all times during the term of this lease, maintain in responsible insurance carriers, which will insure Lessor against force a policy or policies of insurance, written by one or more liability for injury to or deach of persons or loss or damage to property occurring in or about the demised premises. The liability under such insurance shall not be less than $100,000 for any one 8 erson killed or injured, $200,000 for any one accident and 50,000 property damage. ASSIGNMENT: This lease shall not be assigned by the Lessee without the express written consent of the Park Board. RENEWAL: This lease is not subject to automatic renewal, but may be renewed by the Park Board with the approval of the Common Council on an annual basis upon such terms and @conditions as the parties may agree to. the Common Council of the City of Muskego, this lease is hereby executed this day of 9 Pursuant to Resolution $1138-83 passed and approved by Mr. Richard 3.
