CCR1983101c RESOLUTION #101-83 SANITARY SEWER IMPROVEMENTS AND LEVYING SPECIAL FINAL RESOLUTION AUTHORIZING INSTALLATION OF ASSESSMENTS AGAINST BENEFITED PROPERTY WHEREAS, the Common Council of the City of Muskego, Wisconsin, held a public hearing at the City Hall at 7:OO p.m. on the 12th day .) of April, 1983, for the purpose of hearing all interested persons concerning preliminary resolution and report of the City Engineer on the proposed sanitary sewer improvement within the area described below and shown on the attached map and heard all persons who desired to speak at the hearing: Sanitary Sewer Assessment Area For Project MSS-1-83 All that part of the Southeast 1/4 of Section 5, Town 5 North, Range 20 East, City of Muskego, Waukesha County, Wisconsin, described as follows: All abutting properties along the Westerly side of Hillendale Drive from a point approximately 23 ft..North of the centerline of Lembezeder Drive of Lembezeder Drive; together with all abutting to a point approx. 610 ft. North of the-centerline properties along the East side of Hillendale Drive centerline of Lembezeder Drive to a point from a point approximately 210 ft. North of the approximately 578 ft. North of the centerline of measured along the center line of Hillendale Drive. Lembezeder Drive. All of the above limits being NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Muskego as follows: 1. That the report of the City Engineer pertaining to the construction of the above-described public improvements, including plans and specifications therefor is adopted and approved as revised April 1, 1983. 1 I 2. That the City of Muskego has or shall advertise for bids and shall carry out the improvements in accordance with the report cf the City Engineer. 3. That payment for the improvements be made by assessing the cost to the property benefited as indicated in the report. 4. That assessments shown on the report, representing an exercise of the police power, have been determined on a reasonable basis and are hereby confirmed. - - t - 5. That the assessments may be paid in cash in full on or before November 1, 1983 or in ten (10) annual installments to the City Treasurer, installment payments to bear interest at the rate of 9% per annum on the unpaid balance commencing on November 1, 1983 and said first installment being due on the date when real estate taxes are due and annually thereafter. All assessments or installments which are not paid by the date specified shall be extended upon the tax roll as a delinquent tax against the property and all proceedings In relation to the collection, return and sale of property for delinquent real estate taxes shall apply to such special assessment, except as otherwise provided by statute. e. 6. That although a benefit has accrued property, said assessments as to the Clarence to the following Froelich Estate property, Tax Key #2180.999 and the Leona J. Stephens property, Tax Key #2180.995.001 are hereby deferred until such time as connections are available to the sanitary sewer system at which time the assessments shall be paid in cash or in installments as stated above except that the year of the cash payment or commence- ment of installment payments shall be determined by the year in which a sewer connection becomes available in the same manner as stated in Paragraph 5 of this Resolution. That said assessments shall bear no interest until the year in which a sewer connection is available to said property. ~. ~~ 7. That the City Clerk shall publish this resolution as a Class 1 Notice in the assessment district and mail a copy of this resolution and a statement of the final assessment against the benefited property to every property owner whose name appears on the assessment roll whose post office address is known or can with reasonable deligence be ascertained.
