AGREEING TO AN OUT-OF-COURT SETTLEMENT
(As Amended)
REGARDING THE 20 PERCENT WEED CUTTING
SPECIAL CHARGE BY THE LITTLE MUSKEG0
LAKE PROTECTION & REHABILITATION DISTRICT
TO THE CITY OF MGSXEGO
WHEREAS, in 1981 and 1982 there have been two court cases
relating to the 20 percent special charge for weed harvesting
to the City of Muskego by the Little Muskego Lake Protection
and Rehabilitation District, and
WHEREAS, the city has brought legal action in each case to
contest the 20 pexent special charge, and
WHEREAS, the city has paid a 10 percent special charge in
1981, and
WHEREAS, the Chairman of the Lake District Board of Commissioners,
the Lake District Attorney, the Mayor and City Attorney of the
City of Muskego have met regarding this matter, and
WHEREAS, it appears the matter can be settled in the way of a
compromise of 15 percent for each year, and
WHEREAS, the Finance Committee has recommended the city pay
15 percent to the Lake District for weed harvesting,
THEREFORE, BE IT RESOLVED that the Common Council of the City
of Muskego, upon the recommendation of the Finance Committee
does hereby agree to settle said court actions for 15 percent
for the years 1981 and 1982.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute
any documents relating to the special charge to the City of
Muskego by the Little Muskego Lake Protection and Rehabilitation
