AUTHORIZING THE CITY ATTORNEY TO BEGIN
(As Amended)
LEGAL ACTION OBJECTING TO THE 20 PERCENT
PROTECTION AND REHABILITATION DISTRICT OF
SPECIAL CHARGE BY THE LITTLE KUSKEGO LAKE
THEIR 1983 BUDGET AGAINST THE CITY
WHEREAS, on the 2nd day of September, 1982, the qualified
District adopted their 1983 Annual Budget which included a charge
electors of the Little Muskego Lake Protection and Rehabilitation
of 20 percent of the total 1983 budget to the City of Muskego,
and
WHEREAS, the city attorney has determined that the 20 percent
assessment is a special charge under Section 33.32 (5) of the
Wisconsin Statutes, and
WHEREAS, the present action filed by the city against the Little
Muskego Lake Protection and Rehabilitation District regarding
the 1982 special charge is pending, and
THEREFORE BE IT RESOLVED that the Common Council upon the recom-
mendation of the Finance Committee, does hereby authorize the
city attorney to begin legal action objecting to the 20 percent
special charge by the Little Muskego Lake Protection and Re-
habilitation District of their 1983 budget against the city.
BE IT FURTHER RESOLVED that any decision rendered on the 1982 legal
action taken shall be binding on this resolution.
