RESOLUTION NO: 162-82
A RESOLUTION ADOPTING RELOCATION
ORDER OF THE CITY OF MUSKEGO,
WAUKESHA COUNTY, WISCONSIN,
PERTAINING TO THE ACQUISITION OF
A DRAINAGE EASEMENT FROM HENRY A.
HERDEMAN AND PATRICIA H. HERDEMAN,
HIS WIFE.
RELOCATION ORDER OF THE CITY OF MUSKEGO, WAUKESHA COUNTY,
WISCONSIN.
NOW COMES the City of Muskego, Waukesha County, Wisconsin,
by its City Council and for Its Relocation Order, hereby resolves as E follows:
1. That this Resolution is a Relocation Order in
accordance with Section 32.05(1), Wisconsin Statutes, for the
purpose of the hereafter described public improvement project
and It is also a determination of necessity for that project
in accordance with Section 32.07(2), Wisconsin Statutes;
2. That the City of Muskego hereby declares and
determines that It is necessary and a public purpose to
acquire a permanent easement for the maintenance, repair
and reconstruction of an existing storwater drainage tile
which is located within the boundaries of the proposed
easement which Is shown and described on Exhibit A. Exhibit
A is a scale drawing of the proposed easement to be acquired and
is annexed to this Relocation Order and is incorporated
herein;
3. That the legal description of the proposed drainage
eaxment is attached hereto and marked "Exhibit B" and is
incorporated herein;

4. That the City of Muskego will acquire a permanent
easement in the area described in "Exhibit B" from the
present owners, Henry A. Herdeman and Patricia A. Herdeman,
his wife;

8 Proposed Drainage Easement
All that part of the Northwest 1/4 of Section 32, Town 5 North,
Range 20 East, City of Muskego, Naukesha County, Wisconsin being
a 40 ft wide strip of land the centerline of which is described
as follows:
Commencing at the Northwest corner of said Section 32; thence due
East (assumed bearing) along the North line of the Northwest 1/4
of said Section 32 and the centerline of Kelsey Road,966.00 ft;
thence South 22O 45' 00" West, 54.22 ft to a point on the
Southerly right-of-way line of Kelsey Drive and place of beginning;
thence continuing South 22' 45' 00" West, 152.15 ft; thence South
00' 09' 00" West, 458.60 ft; thence South 10' 14' 00" East,
352.63 ft; thence South 1' 30' 00" East, 100.00 ft to the point /
of termination of said 40' wide drainage easement.
