a AUTHORIZING EXECUTION OF CONTRACT BETWEEN LITTLE
XLlSKEGO LAKE PROTECTION AND REHABILITATIUN DISTRICT AND
THE CITY OF EIUSKEGO
IJHEREAS, it is necessary to clarify the original resolution
#87-62 tc‘ indicate clearly that the liabilities involved in the
agreement arc only those arising from the dredging project and
not other liabilities of the Little Muskego Lake Protection and
Rehabilitation District to the City of Muskego,
NOIJ, THEREFORE, BE IS RESOLVED that thc attached agreement
between the City of Muskego and the Little Muskego Lake
Protection and Rehabilitation District is hereby approved by the
Corlrrllvrl Council of the City of Nuskcgo and Lhat Lhe Elayor and City
Clerk are authorized to execute said agreement in the name of the
City. a
BE IT FURTHER RESOLVED that if said clarification agreement
is not executed by the Little Muskego Lake Protection and
Rehabilitation District on or beEore the 31st day of May, 1982,
upon proper authorization of said government body, that this
amended resolution shall be null and void and the original
agreement and resolution shall stand.

AGREEMENT
WHEREAS, the City of Muskego, a municipal corporation,
hereinafter referred to as "City", and the Little Muskego Lake
Protection and Rehabilitation District, a municipal corporation,
hereinafter referred to as "District", have cooperated in past
years on a dredging project for the improvement of the District and,
WHEREAS, the City in the past has advanced certain funds to

the District and acted on behalf of the District in obtaining
certain services for the District and,
WHEREAS, until July 15, 1981, the Common Council constituted
the Board of Commissioners of the District and,
WHEREAS, the State of Wisconsin Department of Natural Resources
has drawn to the attention of the District that they want a more
formal agreement between the City and District as to the liabilities
of the parties as to the dredging project so as to facilitate the
receipt of further grant monies from the US Government and/or from
the State of Wisconsin,
NOW, THEREFORE, for valuable consideration acknowledged by
each party hereto, it is hereby agreed as follows:
1. That all obligations specifically lieted on the attached
document marked Exhibit "A" and made a part hereof were at all times
obligatione of the District although the City at times acted on
the District's behalf in entering contracts for services with third
parties; that the City acting on behalf of the District paid said
obligatione wither directly to the third party or through the
District; that at thie time the District ie indebted to the City for
payment of said obligatione of the District by the City for the
dredging project; that eaid obligations are in the amount of
$214,227.41 and that eaid amount ie due to the City on the 31st day
of December, 1982; that thie agreement doee not reflect any other
liabilities of the Dietrict to the City other than those reflected in
Exhibit "A" for the dredging project.
2. That if thie agreement is not executed upon the proper
authorization by both government unite on or before the 31st day of
.Yay, 1982, it shall be null and void.
