DIRECTING CITY ATTORNEY TO APPEAL CHARGES HADE BY
THE LIWLE MUSKEGO LAKE PROTECTION AND REHAUILITATION
DISTRICT FOR CITY-OWNED LAND IN THE DlSTRlCT

WHEREAS, on the 14th day of September, 1981, the qualified electors
of the Little Muskego Lake Protection and Rehabilitation District
adopted Reso-l-uti-on-~#4-81-LML., entitled, Establishing Tax Levy for
Little Huskego Lake Protection and Rehabilitation District, and
WHEREAS, the resolution was-amended to provide that 20 percent of
the total 1981-82 budget of the Little Muskego Lake Protection and
Rehabilitation District shall be charged to the City uf Muskego,
and
\iIIEHEAS. the city attorney has determined that the 20 pcrcellL
aaattssmenf is a special charge under Sectlou 33.32 (5) ul Llle
Wisconsin Statutes, and
KHEREAS. on the 10th day of November, 1981, the Comon Council
adopted Resolution #179-81, entitled, Appeali~g Charges blade by
the Little Muskego Lake Protection and Rehabilitatlon District
for City-Owned Land in the District, and
WHEREAS, the city attorney has advised that it may not be possible
for the commissioness to change the charge as it was set at the
annuul meeting, and
WHEREAS, a Writ of Certiorari would be the proper method to use
to bring this matter to court,
THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego, upon the advice of the city attorney, does hereby object
to the special assessment of 20 percent of the 1981r1982 budget
for the Little Muskego Lake Protection and Rehabilitation District,
BE IT FURTHER RESOLVED that the city attorney's office is directed
to take whatever action is necessnry to appeal the special charges
by preparing a Writ of Certiorari.
